EFFECTIVE DATE 6 Section 701. Effective date. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 PART I 10 GENERAL PROVISIONS 11 Section 101. Short title.--This act shall be known and may 12 be cited as the General Appropriation Act of 1984. 13 Section 102. Definitions.--The following words and phrases 14 when used in this act shall have the meanings given to them in 15 this section unless the context clearly indicates otherwise: 16 "Employees." Includes all directors, superintendents, bureau 17 or division chiefs, assistant directors, assistant 18 superintendents, assistant chiefs, experts, scientists, 19 engineers, surveyors, draftsmen, accountants, secretaries, 20 auditors, inspectors, examiners, analysts, statisticians, 21 marshals, clerks, stenographers, bookkeepers, messengers and 22 other assistants in any department, board or commission. 23 "Expenses" and "maintenance." Includes all printing, binding 24 and stationery, food and forage, materials and supplies, 25 traveling expenses, training, motor vehicle supplies and 26 repairs, freight, express and cartage, postage, telephones and 27 telegraph rentals and toll charges, newspaper advertising and 28 notices, public advertising by or through any medium (except 29 that no public advertising shall bear a picture or likeness or 30 personal name of any elected or appointed public official), 19840H2051B2784 - 5 -
1 fuel, light, heat, power and water, minor construction and 2 renovation, repairs or reconstruction of equipment, buildings 3 and facilities, rent of real estate and equipment, premiums on 4 workmen's compensation, insurance premiums on policies of 5 liability insurance, insurance premiums on medical payment 6 insurance and surety bonds for volunteer workers, premiums on 7 employee group life insurance and employee and retired employee 8 group hospital and medical insurance, payment of Commonwealth 9 share of social security taxes and unemployment compensation 10 costs for State employees, the purchase of replacement or 11 additional equipment and machinery and all other incidental 12 costs and expenses, including payment to the Department of 13 General Services of mileage and other charges for the use of 14 automobiles and rental payments for permanently assigned 15 automobiles and of expenses or costs of services incurred 16 through the Purchasing Fund. The term "expenses" also shall 17 include the medical costs for the treatment of inmates of State 18 institutions when the inmate must be transferred to an outside 19 hospital: Provided, That in no case shall the State institution 20 pay more for patient care than that provided under the State 21 medical assistance program. 22 Section 103. Abbreviations.--The following abbreviations 23 when used in this act shall have the meanings given to them in 24 this section unless the context clearly indicates otherwise: 25 "ADAMHSBG." State appropriations.--(a) General Fund.--The 8 following sums set forth in this act, or as much thereof as may 9 be necessary, are hereby specifically appropriated from the 10 General Fund to the several hereinafter named agencies of the 11 Executive, Legislative and Judicial Departments of the 12 Commonwealth for the payment of salaries, wages or other 13 compensation and travel expense of the duly elected or appointed 14 officers and employees of the Commonwealth, for payment of fees 15 of contractual services rendered, for the purchase or rental of 16 goods, services, printing, public advertising by or through any 17 medium (except that no public advertising shall bear a picture 18 or likeness or personal name of any elected or appointed public 19 official), equipment, land and buildings and for payment of any 20 other expenses, as provided by law or by this act, necessary for 21 the proper conduct of the duties, functions and activities and 22 for the purposes hereinafter set forth for the fiscal year 23 beginning July 1, 1984 and for the payment of bills incurred and 24 remaining unpaid at the close of the fiscal year ending June 30, 25 1984. 26 (b) Lottery Fund.--The following sums set forth in this act, 27 or as much thereof as may be necessary, are hereby specifically 28 appropriated from the Lottery Fund to the several hereinafter 29 named agencies of the Executive Department of the Commonwealth 30 for the payment of fees of contractual services rendered, for 19840H2051B2784 - 8 -
1 the purchase or rental of goods, services and for payment of any 2 other expenses, as provided by law or by this act, necessary for 3 the proper conduct of the duties, functions and activities and 4 for the purposes hereinafter set forth for the fiscal year 5 beginning July 1, 1984 and for the payment of bills incurred and 6 remaining unpaid at the close of the fiscal year ending June 30, 7 1984. 8 Section 105. Federal augmentation appropriations.--The 9 following Federal augmentation appropriations set forth in this 10 act, or as much thereof as may be necessary, are hereby 11 specifically appropriated from the Federal augmentation funds to 12 the several hereinafter named agencies of the Executive and 13 Judicial Departments of the Commonwealth for the payment of the 14 expenses of implementing and carrying out the programs stated 15 herein for the fiscal year beginning July 1, 1984 and for the 16 payment of bills incurred and remaining unpaid at the close of 17 the fiscal year ending June 30, 1984. Unless otherwise stated, 18 the appropriations include any carryovers from the prior fiscal 19 year. 20 Section 106. Job Training Partnership Act appropriations.-- 21 The following sums as set forth in this act, or as much thereof 22 as may be necessary, are hereby appropriated from the Job 23 Training Partnership Act (JTPA) funds to the several hereinafter 24 named agencies of the Executive Department of the Commonwealth 25 for the payment of the expenses of implementing and carrying out 26 the program stated herein for the fiscal year beginning July 1, 27 1984. 28 Section 107. Jobs Stimulus Bill appropriations.--The 29 following sums set forth in this act, or as much thereof as may 30 be necessary, are hereby specifically appropriated from funds 19840H2051B2784 - 9 -
1 available from the Federal Jobs Stimulus Bill (Public Law 98-8) 2 to the several hereinafter named agencies of the Executive 3 Department of the Commonwealth for the purposes, and under the 4 restrictions, for which the funds are provided for the fiscal 5 year beginning July 1, 1984. 6 Section 108. Block grants.--(a) Appropriation.--The 7 following sums set forth in this act, or as much thereof as may 8 be necessary, are hereby specifically appropriated from the 9 block grant (BG) funds to the several hereinafter named agencies 10 of the Executive Department of the Commonwealth for the 11 purposes, and under the restrictions, for which the funds are 12 provided for the fiscal year beginning July 1, 1984. 13 (b) Small Communities Development Block Grant.--The Small 14 Communities Development Block Grant (SCDBG) is to assist small 15 cities and communities that have a high concentration of 16 impoverished citizens and substandard housing to expand their 17 low and moderate income housing opportunities and to meet 18 community development needs. 19 (c) Community Services Block Grant.--The Community Services 20 Block Grant (CSBG) is to provide a range of services and 21 activities having a measurable and potentially major impact on 22 the causes of poverty in the community or those areas of the 23 community where poverty is a particularly acute problem. In 24 addition, new focus may be placed on the unemployed, both old 25 and new. Local agencies may lower their eligibility requirements 26 for recipients to three months to allow greater flexibility to 27 assure proper consideration of each recipient. 28 (d) Education Consolidation and Improvement Block Grant.-- 29 The Education Consolidation and Improvement Block Grant (ECIBG) 30 will be used for the administration and provision of education 19840H2051B2784 - 10 -
1 programs in accordance with the requirements of the Omnibus 2 Budget Reconciliation Act of 1981: 3 (e) Preventive Health and Health Services Block Grant.--The 4 Preventive Health and Health Services Block Grant (PHHSBG) is 5 for the provision of preventive health and other health services 6 related to emergency medical comprehensive public health, 7 hypertension, fluoridation, health education, risk reduction, 8 home health, rape crisis and rodent control. 9 (f) Maternal and Child Health Services Block Grant.--The 10 Maternal and Child Health Services Block Grant (MCHSBG) is to 11 assure mothers and children access to quality maternal and child 12 health services, to reduce infant mortality and the incidence of 13 preventable disease and handicapping condition among children, 14 provide rehabilitative services for blind and disabled 15 individuals under the age of 16 receiving supplemental security 16 income benefits; and providing medical services for children 17 with crippling conditions. 18 (g) Alcohol and Drug Abuse and Mental Health Services Block 19 Grant.--The Alcohol and Drug Abuse and Mental Health Services 20 Block Grant (ADAMHSBG) will be used for the administration and 21 provision of drug and alcohol abuse services and community 22 mental health services in accordance with the requirements of 23 the Omnibus Budget Reconciliation Act of 1981. 24 (h) Low-Income Energy Assistance Block Grant.--The Low- 25 Income Energy Assistance Block Grant (LIEABG) is to help lessen 26 the impact of the high cost of energy on low-income families and 27 individuals. 28 (i) Social Services Block Grant.--The Social Services Block 29 Grant (SSBG) is for the provision of social services to eligible 30 persons. 19840H2051B2784 - 11 -
1 Section 109. Oil Overcharge Settlement appropriations.--(a) 2 Source of funds.--In accordance with settlements of litigation 3 brought by the United States Department of Energy against oil 4 companies and refineries for alleged violations of the Federal 5 petroleum price allocation regulations and the Further 6 Continuing Appropriations Act of 1983, adopted by Congress in 7 December, 1982 (House Joint Resolution 631), $15,100,000 will be 8 available to the Commonwealth for specific energy conservation 9 programs through the fiscal year ending June 30, 1985. 10 (b) Appropriations.--The following sums set forth in this 11 act, or as much thereof as may be necessary, are hereby 12 specifically appropriated from the restricted receipt account, 13 Oil Overcharge Settlements (OOS), to the several hereinafter 14 named agencies of the Executive Department of the Commonwealth 15 for the payment of the expenses of implementing and carrying out 16 the program stated herein for the fiscal year July 1, 1984 to 17 June 30, 1985. 18 PART II 19 GENERAL FUND AND FEDERAL APPROPRIATIONS 20 FOR 1984-1985 21 SUBPART A 22 EXECUTIVE DEPARTMENT 23 Section 201. Judicial districts 12 comprising more than one county shall 13 be entitled to receive $70,000 per 14 authorized common pleas court judge 15 position; the amount payable to each 16 county shall be determined by the 17 proportion of the individual county's 18 population in relation to the 19 population of the entire judicial 20 district. No county shall be 21 reimbursed for costs above the actual 22 direct costs, excluding capital 23 outlays, incurred by them for the 24 operation of all courts. Department of Transportation.--The following 23 restricted receipt accounts may be established for the 24 Department of Transportation: 25 (1) "Capital Assistance Elderly and Handicapped Programs." 26 (2) "Railroad Rehabilitation and Improvement Assistance." 27 (3) "Ridesharing/Van Pool Program - Acquisition." 28 Section 408. 1 (1) "Receipts from Federal Government - Contributions for 2 Civil Defense Supplies, Equipment and Facilities" - For Federal 3 reimbursement for equipment, supplies and facilities. 4 (2) "Receipts from Federal Government - Contributions for 5 Civil Defense Personnel and Administrative Expenses" - For 6 payment of salaries, benefits and administrative expenses and 7 travel of authorized State and local defense employees. 8 (3) "Receipts from Federal Government - Civil Defense - 9 Disaster Relief Assistance to State and Political Subdivision" - 10 For assistance to State and local governments and to selected 11 private nonprofit facilities in alleviating emergencies arising 12 from major disasters. 13 Section 409. Pennsylvania Historical and Museum 14 Commission.--The following restricted receipt accounts may be 15 established for the Pennsylvania Historical and Museum 16 Commission: 17 (1) "Federal Grant - Historical Preservation Act of 1966" - 18 For deposit and disbursement of Federal funds per regulations of 19 the Historical Preservation Act of 1966. 20 PART V 21 SPECIAL PROVISIONS FOR FEDERAL FUNDS 22 Section 501. General Fund repository for Federal funds.--All 23 moneys received from the Federal Government as contributions or 24 supplements to the departments or agencies of the Commonwealth 25 or the programs herein provided shall be paid into the General 26 Fund and are hereby appropriated out of the General Fund for the 27 purpose of the respective appropriations. 28 Section 502. Limitation on encumbering or spending Federal 29 funds.--Federal funds shall be encumbered or spent only to the 30 extent that such funds are estimated as being available during 19840H2051B2784 - 190 -
1 the fiscal year of the Commonwealth. 2 Section 503. Appropriation of prior unspent Federal funds.-- 3 Any Federal money which has been previously appropriated by the 4 General Assembly and authorized or allocated by the Federal 5 Government but remains unspent from prior fiscal years, and will 6 not be renewed for fiscal year 1984-1985, is hereby 7 appropriated. No funds from any Federal appropriation shall be 8 used to fund the activities of the Human Resources Committee of 9 the Cabinet. 10 Section 504. Subgrants between Federal fund 11 appropriations.--With the exception of Federal money received 12 under JTPA and SSBG, subgrants may be made between 13 appropriations without further approval of the General Assembly. 14 No subgrants shall be made to the Human Resources Committee of 15 the Cabinet. The Secretary of the Budget shall submit a list of 16 subgrants to the Chairmen of the House and Senate Appropriations 17 Committees quarterly. No subgrant to a State agency, however, 18 may be made from a restricted receipt without a specific 19 appropriation by the General Assembly. 20 Section 505. Utilization of emergency Federal funds.--(a) 21 Federal funds available for costs and damages resulting from 22 natural disasters or civil disobedience may be added to an 23 appropriation contained in this act or to funds appropriated or 24 may be used for the purposes prescribed by the Federal 25 Government. 26 (b) In addition to the moneys appropriated by this act, all 27 moneys received from the Federal Government for the purpose of 28 disaster assistance or relief shall be paid into the General 29 Fund and are hereby appropriated out of the General Fund to the 30 departments, boards, commissions or agencies designated by the 19840H2051B2784 - 191 -
1 Governor. 2 (c) In the event of any emergency situation in which the 3 General Assembly cannot act in sufficient time, the Governor is 4 authorized through executive authorization to provide up to 5 $5,000,000 in Federal funds to alleviate the emergency 6 situation. For the purposes of this section "emergency" is 7 defined as any situation in which there is a chance of, or may 8 result in, substantial human suffering. 9 PART VI 10 MISCELLANEOUS PROVISIONS 11 Section 601. Prior laws unaffected.--This act is not 12 intended to be inconsistent with or to repeal any provision of 13 any act enacted at this or any prior session of the General 14 Assembly regulating the purchase of supplies, the ordering of 15 printing and binding, the purchase, maintenance and use of 16 automobiles, the method of making payments from the State 17 Treasury for any purpose or the functioning of any 18 administrative department, board or commission. 19 Section 602. Compliance with other law before funds 20 available.--No appropriation made by this act to any department, 21 board, commission or agency of the Executive Department shall be 22 available unless and until the department, board, commission or 23 agency has complied with sections 615 and 616 of the act of 24 April 9, 1929 (P.L.177, No.175), known as The Administrative 25 Code of 1929. 26 Section 603. Contracts prerequisite to encumbering or 27 committing funds.--(a) Funds for the purchase of supplies, 28 materials and equipment shall not be deemed to be committed or 29 encumbered until contracts covering the purchase have been 30 entered into with the vendors. 19840H2051B2784 - 192 -
1 (b) No public advertising by any Executive or Judicial 2 Department receiving any appropriation under this act or any 3 supplements thereto shall bear a picture or likeness or the 4 personal name of any elected or appointed public official. 5 Section 604. Minority business set asides.--(a) Each 6 department or other instrumentality of the Commonwealth listed 7 in Subpart A of Part II, authorized to contract for buildings, 8 highways, commodities, equipment, supplies or services, shall 9 report to the General Assembly all information pertinent to 10 anticipated procurement needs at the beginning of each fiscal 11 year and each fiscal quarter thereafter. 12 (b) As used in this section the term "minority business" 13 means a minority business enterprise as defined in the act of 14 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania 15 Minority Business Development Authority Act. 16 Section 605. Appropriation of funds from miscellaneous 17 sources.--(a) In addition to the amounts appropriated by this 18 act, moneys received in payment for food and household supplies 19 furnished to employees and other persons, except inmates, by an 20 institution, and moneys received from the proceeds from the sale 21 of any products of the soil, meats, livestock, timber or other 22 materials sold by the department, shall be paid into the General 23 Fund and are hereby appropriated out of the General Fund to the 24 several respective institutions for the operation and 25 maintenance of the institutions. 26 (b) In addition to the amounts appropriated by this act, all 27 moneys received from any other source, except the Federal 28 Government, as contributions for the programs provided herein, 29 or as payment for services or materials furnished by one 30 institution to another, except those collections designated as 19840H2051B2784 - 193 -
1 revenues, shall be paid into the General Fund and are hereby 2 appropriated out of the General Fund for the purposes of the 3 respective appropriations. 4 (c) In addition to any funds specifically appropriated by 5 this act, all moneys received by a department or agency of the 6 Commonwealth from any other sources, except the Federal 7 Government, as contributions or supplements to the department or 8 agency for a program or administration of an act included in 9 this act shall be paid into the General Fund and credited to the 10 appropriation for that program or administration of the act. 11 Section 606. Lapsing of unused funds.--(a) Except as 12 provided in subsections (b), (c), (d), (e),(f), (g) and (h), 13 that part of all appropriations in Part II unexpended, 14 uncommitted or unencumbered as of June 30, 1985 shall 15 automatically lapse as of that date. 16 (b) The appropriation in Part II to the Crime Victims 17 Compensation Board for payment of claims shall be a continuing 18 appropriation. 19 (c) The appropriations in Part II to the Department of 20 Commerce for the various ports shall be a continuing 21 appropriation. 22 (d) The appropriations in Part II to the Department of 23 Community Affairs for housing and redevelopment assistance and 24 enterprise development shall be a continuing appropriation. 25 (e) The appropriation in Part II to the Department of 26 Education for asbestos and deferred maintenance programs shall 27 be a continuing appropriation. 28 (f) The appropriation in Part II to the Department of 29 Environmental Resources for hazardous waste control shall be a 30 continuing appropriation. 19840H2051B2784 - 194 -
1 (g) The appropriation in Part II to the Department of 2 General Services for tort claims shall be a continuing 3 appropriation. 4 (h) The appropriations in Part II to the Legislative 5 Department shall be continuing appropriations. 6 PART VII 7 EFFECTIVE DATE 8 Section 701.
