AN ACT
1 Amending the act of November 4, 1983 (P.L.217, No.63), entitled
2 "An act establishing a program of limited pharmaceutical
3 assistance for the elderly; granting powers to and imposing
4 duties on the Department of Aging; establishing a payment
5 system; making provisions for funding; providing for reports;
6 and fixing penalties for violations of the pharmaceutical
7 assistance program," and including the permanently disabled
8 within the program.
9 The General Assembly of the Commonwealth of Pennsylvania
10 hereby enacts as follows:
11 Section 1. Sections 1, 2, definitions of "eligible claimant"
12 and "program" in section 3 and section 4(d) of the act of
13 November 4, 1983 (P.L.217, No.63), known as the Pharmaceutical
14 Assistance Contract for the Elderly Act, are amended to read:
15 Section 1. Short title.
16 This act shall be known and may be cited as the
17 Pharmaceutical Assistance Contract for the Elderly and Disabled
18 Act.
19 Section 2. Legislative findings.
20 Finding that an increasing number of the Commonwealth's
1 elderly and disabled citizens who are living on fixed incomes 2 are experiencing difficulties in meeting the costs of life- 3 sustaining prescription drugs, the General Assembly, in its 4 responsibilities to provide for the health, welfare and safety 5 of its residents, hereby establishes a limited State 6 pharmaceutical assistance program for the elderly and disabled. 7 Section 3. Definitions. 8 The following words and phrases when used in this act shall 9 have the meanings given to them in this section unless the 10 context clearly indicates otherwise: 11 * * * 12 "Eligible claimant." A resident of the Commonwealth 65 years 13 of age and over or permanently disabled and receiving medicare 14 benefits, whose annual income is less than the maximum annual 15 income, and who is not otherwise qualified for public assistance 16 under the act of June 13, 1967 (P.L.31, No.21), known as the 17 Public Welfare Code. 18 * * * 19 "Program." The pharmaceutical assistance contract for the 20 elderly and disabled as established by this act. 21 Section 4. Responsibilities of Department of Aging. 22 * * * 23 (d) Request for proposal.--The department shall prepare a 24 request for proposal for the purpose of providing pharmaceutical 25 assistance for the elderly and disabled within this 26 Commonwealth. The request for proposal shall require private 27 contractors to submit a three-year proposal not to exceed 28 $300,000,000. Upon the adoption of the General Fund Budget, the 29 Department of Revenue shall transmit the appropriated funds in 30 the State Lottery Fund to the State Treasurer to be deposited in 19840H2026B2754 - 2 -
1 the Pharmaceutical Assistance Contract for the Elderly and 2 Disabled Fund to be created by the State Treasurer to fund the 3 operations of the program. Funds not expended in the fiscal year 4 in which they were appropriated shall not lapse and be available 5 for use in the next fiscal year. 6 * * * 7 Section 2.
