AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, providing for letters of warning for certain
3 violations by official inspection stations.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 4724(a) of Title 75 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 4724. Suspension of certificates of appointment.
9 (a) General rule.--
10 (1) The department shall supervise and inspect official
11 inspection stations and may suspend the certificate of
12 appointment issued to a station which it finds is not
13 properly equipped or conducted or which has violated or
14 failed to comply with any of the provisions of this chapter
15 or regulations adopted by the department. The department
16 shall maintain a list of all stations holding certificates of
17 appointment and of those whose certificates of appointment
18 have been suspended. Any suspended certificate of appointment
1 and all unused certificates of inspection shall be returned
2 immediately to the department.
3 (2) Notwithstanding paragraph (1), the department may
4 suspend a certificate of appointment only if, during the
5 previous five-year period, the inspection station had a
6 previous incident of violation or noncompliance. If there is
7 no such record, the department may issue only a letter of
8 warning.
