                                     AN ACT

     1  Creating and establishing the Legislative Job Training
     2     Partnership Oversight Committee; providing for its
     3     membership; prescribing its powers, functions and duties; and
     4     making an appropriation.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7  Section 1.  Short title.
     8     This act shall be known and may be cited as the Job Training
     9  Partnership Oversight Committee Act.
    10  Section 2.  Declaration of policy.
    11     (a)  Findings.--The General Assembly finds that:
    12         (1)  Government supported job training programs are
    13     intended to be an investment in the development of the
    14     State's workforce and, as such, job training programs should
    15     provide participants with an upgrading of skills according to
    16     measurable criteria; that such new skills should be in demand
    17     and marketable and that the persons trained should be able to
    18     obtain permanent jobs.


     1         (2)  State and local activities being carried out under
     2     the Federal Job Training Partnership Act should be
     3     implemented and coordinated so as to facilitate the
     4     achievement of the above stated goals.
     5     (b)  Intent.--It is, therefore, the intent of this act to
     6  create a means through which the General Assembly can have
     7  oversight of job training programs in order to determine whether
     8  such programs are being operated in a manner to best facilitate
     9  the goals and purposes stated herein.
    10  Section 3.  Definitions.
    11     The following words and phrases when used in this act shall
    12  have the meanings given to them in this section unless the
    13  context clearly indicates otherwise:
    14     "Committee."  The Legislative Job Training Partnership
    15  Oversight Committee created by this act.
    16     "Federal act."  The Federal Job Training Partnership Act of
    17  1982 (Public Law 97-300).
    18     "Governor's plan."  The Governor's coordination and special
    19  services plan as provided in section 121 of the Federal act.
    20     "Private industry council."  The council provided for in
    21  section 102 of the Federal act.
    22     "Service delivery area."  A geographic area designated by the
    23  Governor in accordance with section 101 of the Federal act.
    24     "State council."  The Governor's Employment and Training
    25  Council as provided for in section 122 of the Federal act.
    26  Section 4.  Creation of committee.
    27     (a)  Creation of committee.--There is hereby created the
    28  Legislative Job Training Partnership Oversight Committee which
    29  shall consist of the President pro tempore of the Senate, the
    30  Majority Leader of the Senate, the Minority Leader of the

     1  Senate, the Speaker of the House of Representatives, the
     2  Majority Leader of the House of Representatives and the Minority
     3  Leader of the House of Representatives. Each officer of the
     4  Senate and the House of Representatives may designate another
     5  member of their respective Houses to be a member of the
     6  committee in their stead or to temporarily act on behalf of such
     7  officer. Members of the committee shall serve during each
     8  regular session of the General Assembly and shall continue as
     9  members until the first Tuesday in January of the next odd-
    10  numbered year and until their respective successors shall
    11  qualify, provided they continue to be members of the Senate or
    12  the House of Representatives. The committee has a continuing
    13  existence and may meet and conduct its business at any place
    14  within the Commonwealth during the sessions of the General
    15  Assembly or any recess thereof and in the interim between
    16  sessions.
    17     (b)  Appointment of officers.--The committee shall have the
    18  power and duty to appoint its own chairman, vice chairman and
    19  other officers and to make rules and regulations governing its
    20  proceedings.
    21  Section 5.  Powers and duties of committee.
    22     The committee shall have the following powers and duties:
    23         (1)  To track all expenditures of money received through
    24     the various provisions of the Federal act including money
    25     allocated to the service delivery areas.
    26         (2)  To gain access to the computer systems and
    27     management information systems as provided for by the State
    28     plan.
    29         (3)  To monitor the coordination of State agencies and
    30     the Pennsylvania Job Service with the service delivery areas

     1     and among the agencies to insure a lack of duplication of
     2     efforts and maximum efficiency.
     3         (4)  To review the operation of programs conducted in
     4     each service delivery area and the availability,
     5     responsiveness and adequacy of State services.
     6         (5)  To hire staff, including, but not limited to, an
     7     executive director and legal counsel.
     8         (6)  To inspect any documents relating to either
     9     financial data or provision of services at both the State and
    10     service delivery area levels.
    11         (7)  To make periodic reports and recommendation to the
    12     General Assembly and the State council on the status of the
    13     Job Training Partnership in Pennsylvania.
    14         (8)  To conduct public hearings to solicit testimony as
    15     deemed necessary by the commission.
    16         (9)  To purchase or rent equipment and supplies as the
    17     committee may deem necessary in the performance of its
    18     duties.
    19  Section 6.  Cooperation of concerned agencies.
    20     The Governor, State council, each private industry council,
    21  each grant recipient, and every agency of government, both State
    22  and local, involved in the administration or operation of any of
    23  the provisions of the Federal act shall cooperate fully with the
    24  committee in the performance of its duties and shall make
    25  available to the committee, upon request, all information,
    26  documents, computer data and all other material deemed necessary
    27  by the committee in the performance of its duties.
    28  Section 7.  Compensation and expenses.
    29     The members of the committee shall serve without compensation
    30  but shall be reimbursed for their expenses incurred while

     1  attending sessions of the committee or meetings of any
     2  subcommittee of the committee, or while engaged on other
     3  committee business authorized by the committee, and in going to
     4  and coming from meetings of the committees or its subcommittees
     5  or for travel and other committee business when authorized by
     6  the committee.
     7  Section 8.  Appropriation.
     8     The sum of $200,000, or as much thereof as may be necessary,
     9  is hereby specifically appropriated to the Legislative Job
    10  Training Partnership Oversight Committee to pay the expenses of
    11  the members of the committee and for the salary or compensation
    12  of the executive director, staff and other hire and incidental
    13  expenses.
    14  Section 9.  Effective date.
    15     This act shall take effect immediately.
