        AS REPORTED FROM COMMITTEE ON CONSERVATION, HOUSE OF
           REPRESENTATIVES, AS AMENDED, JANUARY 31, 1984

                                     AN ACT

     1  Requiring the Department of Environmental Resources to publish
     2     and advertise the text of certain consent agreements and
     3     orders and make copies of such orders and agreements
     4     available at regional offices.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7  Section 1.  Notice requirement.
     8     All A SUMMARY OF ALL proposed consent agreements and orders    <--
     9  in which the Department of Environmental Resources will enter
    10  into with any other person having to do with any facet of
    11  regulatory enforcement shall first be published in their          <--
    12  entirety in the Pennsylvania Bulletin at least 30 days prior to
    13  the entering into the actual consent agreements. NOTICE OF WHOM   <--
    14  AN INTERESTED PARTY CAN CONTACT TO RECEIVE THE ENTIRE CONSENT
    15  AGREEMENT AND ORDER SHALL ALSO BE PUBLISHED. The 30-day period
    16  shall be provided for the purpose of public comment and imput.
    17  It may not be waived. In addition to this requirement, the
    18  Department of Environmental Resources shall cause the same to be

     1  published in a newspaper of general circulation within the area
     2  which would be affected by the consent agreement and order no
     3  later than 30 days after the consent agreement and order.
     4  Section 2.  Copies.
     5     The regional offices of Department of Environmental Resources
     6  shall make available for inspection or photocopying all copies
     7  of documents referred to in section 1 as well as copies of the
     8  applicable Pennsylvania Bulletin and newspaper notices to any
     9  person who makes a request.
    10  Section 3.  Effective date.
    11     This act shall take effect immediately.
