AN ACT
1 Requiring the Department of Environmental Resources to publish
2 and advertise the text of certain consent agreements and
3 orders and make copies of such orders and agreements
4 available at regional offices.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Notice requirement.
8 All proposed consent agreements and orders in which the
9 Department of Environmental Resources will enter into with any
10 other person having to do with any facet of regulatory
11 enforcement shall first be published in their entirety in the
12 Pennsylvania Bulletin at least 30 days prior to the entering
13 into the actual consent agreements. The 30-day period shall be
14 provided for the purpose of public comment and imput. It may not
15 be waived. In addition to this requirement, the Department of
16 Environmental Resources shall cause the same to be published in
17 a newspaper of general circulation within the area which would
18 be affected by the consent agreement and order no later than 30
1 days after the consent agreement and order.
2 Section 2. Copies.
3 The regional offices of Department of Environmental Resources
4 shall make available for inspection or photocopying all copies
5 of documents referred to in section 1 as well as copies of the
6 applicable Pennsylvania Bulletin and newspaper notices to any
7 person who makes a request.
8 Section 3. Effective date.
9 This act shall take effect immediately.
