                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, further providing for the
     3     review and enforcement of child support orders.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 6708 of Title 42 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a subsection to read:
     8  § 6708.  Enforcement of support orders.
     9     * * *
    10     (c)  Collection of delinquent payments.--If, within any 12-
    11  week period the ordered payment has not been made by a defendant
    12  under an order of support for four or more weeks, either
    13  separately or consecutively, then the court may refer that case
    14  to a private attorney whose office is located in the same county
    15  as the court. The attorney may initiate and pursue the necessary
    16  legal action in order to collect the delinquent payments and,


     1  when those payments are recovered through the efforts of the
     2  private attorney, he shall receive, as a fee, an amount equal to
     3  30% of the amount recovered. This fee shall be in addition to
     4  and not subtracted from the amount recovered. All costs incurred
     5  in pursuing the action and the attorney's fee shall be borne by
     6  the delinquent party and an order shall be entered requiring him
     7  to pay the costs and fee to the domestic relations section for
     8  transmission to the attorney. This order shall have the same
     9  effect as an order of support and shall be enforceable in the
    10  same manner. This subsection applies only to support payments
    11  which are to be transmitted to a public body or agency, as
    12  provided by section 6706 (relating to payee of order of
    13  support).
    14     Section 2.  This act shall take effect in 60 days.
