                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for payments to school
     6     districts to cover a portion of the costs to control or
     7     eliminate the health problems posed by the presence of
     8     asbestos in public schools.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    12  as the Public School Code of 1949, is amended by adding a
    13  section to read:
    14     Section 2511.2.  Payments for Programs to Eliminate Asbestos
    15  in Public Schools.--(a)  Each school district shall be entitled
    16  to receive from the Department of Education payments to
    17  reimburse the district for fifty per centum (50%) of the costs
    18  incurred in programs, approved by the Department of Education,
    19  to enclose or encapsulate asbestos in district schools, or for


     1  seventy-five per centum (75%) of the costs incurred in programs,
     2  approved by the Department of Education, to remove and replace
     3  asbestos materials in district schools. If the school district
     4  receives Federal funds for this purpose, the Commonwealth shall
     5  reimburse the district for the appropriate percentage of the
     6  costs incurred by the district after subtracting the amount of
     7  Federal funds received from the total cost of the program.
     8     (b)  The reimbursement of the approved costs shall be made to
     9  a school district over a three-year period with equal payment in
    10  each year. Such payments shall be made each year at the time the
    11  final payments are made to the school districts in accordance
    12  with section 2517.
    13     (c)  School districts shall be entitled to reimbursement for
    14  said costs incurred on and after January 1, 1977 if such costs
    15  are approved by the department. A school district shall have two
    16  years from the effective date of this amendatory act to apply
    17  for reimbursement.
    18     (d)  The Department of Environmental Resources shall be
    19  responsible for inspection and verification of all programs for
    20  which reimbursement is sought.
    21     Section 2.  This act shall take effect July 1, 1984.
