                                     AN ACT

     1  Prohibiting the transfer of certain human organs for valuable
     2     consideration.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Prohibition of organ purchases.
     6     (a)  General rule.--It is unlawful for any person to
     7  knowingly acquire, receive or otherwise transfer any human organ
     8  for valuable consideration.
     9     (b)  Penalty.--Any person who violates subsection (a) commits
    10  a misdemeanor of the first degree and, upon conviction, shall be
    11  fined not more than $50,000 or imprisoned not more than five
    12  years, or both.
    13     (c)  Definitions.--As used in this section the following
    14  words and phrases shall have the meanings given to them in this
    15  subsection:
    16     "Human organ."  The human kidney, liver, heart, lung,


     1  pancreas and any other human organ or tissue including corneas,
     2  bone and skin.
     3     "Valuable consideration."  Does not include the reasonable
     4  costs associated with the removal, storage and transportation of
     5  a human organ, but includes any other consideration.
     6  Section 2.  Effective date.
     7     This act shall take effect immediately.
