                                     AN ACT

     1  Amending the act of July 28, 1953 (P.L.723, No.230), entitled
     2     "An act relating to counties of the second class and second
     3     class A; amending, revising, consolidating and changing the
     4     laws relating thereto," providing a limited preference for
     5     certain bidders.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The act of July 28, 1953 (P.L.723, No.230), known
     9  as the Second Class County Code, is amended by adding a section
    10  to read:
    11     Section 2002.1.  Limited Preference in Bidding.--
    12  Notwithstanding any other provision of this or any other law to
    13  the contrary, in every case in which the county, any of its
    14  departments, agencies, bureaus, boards, commissions or
    15  instrumentalities, is authorized or required to write proposals
    16  and let contracts for supplies, equipment, materials,
    17  construction or services, if the amount of the proposal
    18  submitted by a bidder organized and existing under the laws of
    19  this Commonwealth and regularly doing business in this

     1  Commonwealth exceeds the amount of the actual lowest proposal by
     2  ten per centum (10%) or less, the proposal of the Commonwealth
     3  bidder shall be considered on the same basis as if it were in
     4  the amount of the actual lowest bid.
     5     Section 2.  All other acts and parts of acts are repealed
     6  insofar as they are inconsistent with this act.
     7     Section 3.  This act shall apply to bid proposals advertised
     8  on and after the date of enactment.
     9     Section 4.  This act shall take effect in 60 days.
