                                     AN ACT

     1  Amending the act of July 1, 1978 (P.L.584, No.109), entitled "An
     2     act establishing an agency to create the linkage necessary
     3     for the planning of an economic development system for
     4     Pennsylvania, and making an appropriation," providing for the
     5     establishment, operation and functions of area labor
     6     management committees; extending the existence of the
     7     council, making appropriations; and making a repeal.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 2 of the act of July 1, 1978 (P.L.584,
    11  No.109), known as the Milrite Act, is amended by adding a
    12  definition to read:
    13  Section 2.  Definitions.
    14     The following words and phrases when used in this act shall
    15  have, unless the context clearly indicates otherwise, the
    16  meanings given to them in this section:
    17     "Area Labor Management Committee (ALMC)."  An organization of
    18  members from both the business community and organized labor in
    19  a particular geographic area created for the purposes of:
    20         (1)  Improving communications between labor and

     1     management.
     2         (2)  Providing a forum to discuss and investigate ways to
     3     further the goals of increased quality of work life and
     4     increased productivity.
     5         (3)  Discovering ways to improve organizational
     6     effectiveness.
     7         (4)  Finding solutions to problems of mutual concern to
     8     both labor and management not susceptible to resolution
     9     within the collective bargaining structure.

    11     Section 2.  Sections 6 and 7 of the act are amended to read:
    12  Section 6.  Powers and duties of council.
    13     The council shall have the following powers and duties:
    14         (1)  Undertake research and investigation relating to the
    15     promotion of the industrial potential of Pennsylvania.
    16         (2)  Create plans for economic revitalization of
    17     Commonwealth industries.
    18         (3)  Recommend implementation procedures for all plans,
    19     maximizing existing mechanisms with proven ability to
    20     accomplish tasks, linkages among current programs, business,
    21     labor and government insights into practicality and
    22     workability of suggested approaches.
    23         (4)  Encourage and stimulate cooperation and coordination
    24     among Federal, State and local programs.
    25         (5)  Recommend structural changes and updating of
    26     economic delivery tools of State Government to the Governor
    27     and General Assembly.
    28         (6)  Draw upon labor, management and government
    29     participants to promulgate plans and implement procedures.
    30         (7)  Recommend organizational structure and participants

     1     particularly suited to local needs and conditions.
     2         (8)  Support the organization, establishment and
     3     operation of local and regional Area Labor Management
     4     Committees by providing technical and other available
     5     assistance.
     6         (9)  Provide for a Statewide organization for area labor
     7     management committees to foster the exchange of information
     8     between area labor management committees.
     9         [(8)]  (10)  The council shall have the power to:
    10             (i)  Enter into contracts.
    11             (ii)  Appoint, fix compensation of, and prescribe
    12         duties of an executive director, secretary and such other
    13         personnel as the council deems necessary to accomplish
    14         the purposes of this act.
    15             (iii)  Retain counsel.
    16             (iv)  Accept grants from public and private sources.
    17             (v)  Borrow money and issue obligations, secured or
    18         unsecured, to acquire, hold, own and pledge or dispose of
    19         funds, money, securities and other property, real or
    20         personal, tangible or intangible to the extent necessary
    21         to carry out the purposes of this act.
    22             (vi)  Adopt and promulgate rules and regulations
    23         necessary to accomplish the provisions of this act.
    24  Section 7.  Limited duration.
    25     The council shall cease to exist [six] twelve years from the
    26  effective date of this act unless the General Assembly extends
    27  its life.
    28     Section 3.  (a)  The sum of $400,000, or as much thereof as
    29  may be necessary, is specifically appropriated to the Milrite
    30  Council for the fiscal year July 1, 1983 to June 30, 1984 for

     1  the purpose of providing grants to Area Labor Management
     2  Committees.
     3     (b)  The sum of $100,000, or as much thereof as may be
     4  necessary, is specifically appropriated to the Milrite Council
     5  for the fiscal year July 1, 1980 to June 30, 1984 for the
     6  purposes of implementing the provisions of section 2 of this
     7  act.
     8     Section 4.  As much of section 212 as related to the
     9  appropriation to the Milrite Council for grants to industry and
    10  Area Labor Management Committees of the act of July 21, 1983
    11  (No.7A), is repealed.
    12     Section 5.  This act shall take effect immediately.
