AN ACT 1 Amending the act of May 1, 1933 (P.L.103, No.69), entitled "An 2 act concerning townships of the second class; and amending, 3 revising, consolidating, and changing the law relating 4 thereto," further providing for the prohibition of nuisances. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 702 XII of the act of May 1, 1933 8 (P.L.103, No.69), known as The Second Class Township Code, 9 reenacted and amended July 10, 1947 (P.L.1481, No.567) and 10 amended March 21, 1968 (P.L.66, No.22), is amended to read: 11 Section 702. Supervisors to Exercise Powers.--* * * 12 XII. Nuisances.--To prohibit nuisances, including but not 13 limited to, accumulations of garbage and rubbish, infestations 14 of bats or rats, and the storage of abandoned or junked 15 automobiles, on private and public property, and the carrying on 16 of any offensive manufacture or business; and to remove any 17 nuisance or dangerous structure on public or private grounds 18 after notice to the owner to do so, and, in his default, to
1 collect the cost of such removal, together with such penalty as 2 may be prescribed by ordinance from the owner by summary 3 proceedings or in the manner provided for the collection of 4 municipal claims or by an action of assumpsit without the filing 5 of a claim. In the exercise of the powers herein conferred, the 6 township may institute proceedings in courts of equity. 7 * * * 8 Section 2. This act shall take effect immediately.
