                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing information concerning prior
     3     convictions be withheld prior to sentencing.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3929(b) of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 3929.  Retail theft.
     9     * * *
    10     (b)  Grading.--
    11         (1)  Retail theft constitutes a:
    12             (i)  Summary offense when the offense is a first
    13         offense and the value of the merchandise is less than
    14         $150.
    15             (ii)  Misdemeanor of the second degree when the
    16         offense is a second offense and the value of the
    17         merchandise is less than $150.
    18             (iii)  Misdemeanor of the first degree when the

     1         offense is a first or second offense and the value of the
     2         merchandise is $150 or more.
     3             (iv)  Felony of the third degree when the offense is
     4         a third or subsequent offense, regardless of the value of
     5         the merchandise.
     6         (2)  Amounts involved in retail thefts committed pursuant
     7     to one scheme or course of conduct, whether from the same
     8     store or retail mercantile establishment or several stores or
     9     retail mercantile establishments, may be aggregated in
    10     determining the grade of the offense.
    11         (3)  No information concerning a prior conviction
    12     relating to this section shall be presented to the trier of
    13     fact in a court of record prior to sentencing.

    15     Section 2.  This act shall take effect in 60 days.
