A SUPPLEMENT 1 To the act of November 26, 1982 (P.L.755, No.209), entitled "An 2 act providing for the capital budget for the fiscal year 3 1982-1983," itemizing a public improvement project to be 4 constructed or acquired by the Department of General 5 Services, together with its estimated financial cost; 6 authorizing the incurring of debt without the approval of the 7 electors for the purpose of financing the project to be 8 constructed or acquired by the Department of General 9 Services, stating the estimated useful life of the project; 10 making an appropriation; and making a repeal. 11 The General Assembly of the Commonwealth of Pennsylvania 12 hereby enacts as follows: 13 Section 1. Total authorization. 14 The total authorization for the additional capital project in 15 the category of Public Improvement Projects itemized in section 16 2 and to be acquired or constructed by the Department of General 17 Services, its successors or assigns, and to be financed by the 18 incurring of debt, shall be $22,067,000. 19 Section 2. Itemization of a Public Improvement Project. 20 An additional capital project in the category of Public 21 Improvement Projects to be constructed or acquired by the
1 Department of General Services, its successors or assigns, and 2 to be financed by the incurring of debt, is hereby itemized, 3 together with its respective estimated financial costs as 4 follows: 5 Project Base Design and Total 6 Project Contingency Project 7 Allocation Allocation Allocation 8 (1) Department of 9 General Services $18,388,740 $22,067,000 10 (i) Harrisburg 11 (A) Renovation and 12 Conversion of Old 13 Museum Building 14 for Administrative 15 Offices, Project 16 No. DGS 946-2. The 17 Base Construction 18 Authorization 19 includes 20 $4,500,000 for 21 support systems 22 and plaza area 23 construction 24 tied into DGS 25 948-12, Capitol 26 Addition. 1 previously 2 authorized 3 for the 4 renovation 5 and con- 6 version of 7 the Old 8 Museum 9 Building $18,388,740 $22,067,000 10 Section 3. Debt authorizations. 11 The Governor, Auditor General and State Treasurer are hereby 12 authorized and directed to borrow, from time to time, in 13 addition to any authorization heretofore or hereafter enacted, 14 on the credit of the Commonwealth, subject to the limitations 15 provided in the current Capital Budget, money not exceeding in 16 the aggregate the sum of $22,067,000 as may be found necessary 17 to carry out the acquisition and construction of the public 18 improvement projects specifically itemized in a Capital Budget. 19 Section 4. Issue of bonds. 20 The indebtedness herein authorized shall be incurred from 21 time to time and shall be evidenced by one or more series of 22 general obligation bonds of the Commonwealth in such aggregate 23 principal amount for each series as the Governor, Auditor 24 General and State Treasurer shall determine, but the latest 25 stated maturity date shall not exceed the estimated useful life 26 of the project being financed as stated in section 5. 27 Section 5. Estimated useful life of project. 28 The General Assembly states that the estimated useful life of 29 the project heretofore itemized is 30 years. 30 Section 6. Appropriation. 19830H1406B1718 - 3 -
1 The net proceeds of the sale of the obligations herein 2 authorized are hereby appropriated from the Capital Facilities 3 Fund to the Department of General Services in the maximum amount 4 of $22,067,000 to be used by it exclusively to defray the 5 financial cost of the public improvement projects specifically 6 itemized in a Capital Budget. After reserving or paying the 7 expenses of the sale of the obligation, the State Treasurer 8 shall pay to the Department of General Services the moneys as 9 required and certified by it to be legally due and payable. 10 Section 7. Allocation of funds. 11 Whenever as determined by the Department of General Services 12 that the full estimated financial cost of the public improvement 13 project itemized in section 1 are not necessary for the proper 14 design, acquisition or construction of the projects, the excess 15 funds no longer required may be allocated to increase the 16 estimated cost of any one or more of the public improvement 17 projects specifically itemized in a Capital Budget. 18 Section 8. Repeals. 19 Subclause (8) of Clause VIII of section 2 of the act of 20 August 14, 1963 (P.L.1032, No.451), entitled "An act amending 21 the act of March 31, 1949 (P.L.372, No.34), entitled 'An act to 22 promote the welfare of the people of the Commonwealth; creating 23 The General State Authority as a body corporate and politic with 24 power to construct, improve, equip, furnish, and operate 25 projects, and to lease the same, and to fix fees, rentals, and 26 charges for the use thereof; authorizing and regulating the 27 issuance of bonds for said Authority, and providing for the 28 payment of such bonds, and the rights of the holders thereof; 29 and to enter into agreements with the Government of the United 30 States or any Federal agency; and authorizing the Department of 19830H1406B1718 - 4 -
1 Property and Supplies to grant, assign, convey, or lease to the 2 Authority lands of the Commonwealth and interests therein, and 3 to acquire lands therefor; granting the right of eminent domain; 4 empowering The General State Authority to sell and convey 5 projects and property to the Commonwealth; and providing that no 6 debt of the Commonwealth shall be incurred in the exercise of 7 any of the powers granted by this act,' increasing the powers 8 and the borrowing capacity of the Authority, allocating the 9 proceeds of such borrowing capacity, and regulating the leasing 10 of projects constructed for State aided institutions," is hereby 11 repealed. Any funds expended or encumbered under the 12 authorization contained in the act of August 14, 1963, shall be 13 transferred to this new authorization. 14 Section 9.
