AN ACT
1 Authorizing and directing the Department of General Services,
2 with the approval of the Governor and the Department of
3 Public Welfare, to convey to Canaan Township 2.307 acres of
4 land, more or less, situate in Canaan Township, Wayne County,
5 Pennsylvania.
6 The General Assembly of the Commonwealth of Pennsylvania
7 hereby enacts as follows:
8 Section 1. The Department of General Services, with the
9 approval of the Governor and the Department of Public Welfare,
10 is hereby authorized and directed on behalf of the Commonwealth
11 of Pennsylvania to grant and convey, for a consideration of one-
12 half of the fair market value as determined by an independent
13 appraisal to Canaan Township, the following tract of land
14 situate in Canaan Township, Wayne County, Pennsylvania,
15 described in accordance with a plan prepared for Canaan
16 Township, dated May 9, 1983, as prepared by Alfred K. Bucconear,
17 Honesdale, Pennsylvania and bounded and described as follows:
18 All that certain piece, parcel or tract of land lying,
19 situate and being in the Township of Canaan, County of Wayne and
1 Commonwealth of Pennsylvania, bounded and described as follows,
2 to witness:
3 Beginning at a point or corner, located in the centerline of
4 Pennsylvania Legislative Route No. 63102, being a common corner
5 of lands of Farview State Hospital for the Criminal Insane and
6 being located on a projection of the southern division line of
7 lands of Lewis C. and Margaret A. Henshaw - Deed: 375, Page:
8 193; thence, along the centerline of the aforesaid Pennsylvania
9 Legislative Route No. 63102, south 06 degrees 26 minutes 00
10 seconds west 209.00 feet to a point or corner; thence, departing
11 from said roadway, along the northern division line of lands of
12 William A. Salak - Deed: 368, Page: 365 and through lands of the
13 aforesaid Farview State Hospital for the Criminal Insane, north
14 82 degrees 08 minutes 00 seconds west 453.58 feet to an iron pin
15 corner set; thence, continuing through lands of the aforesaid
16 Farview State Hospital for the Criminal Insane, north 10 degrees
17 08 minutes 00 seconds east 241.60 feet to an iron pin corner
18 set, being the southwest corner of lands of the aforesaid Lewis
19 C. and Margaret A. Henshaw; thence, along the southern division
20 line of lands of the aforesaid Lewis C. and Margaret A. Henshaw,
21 south 77 degrees 54 minutes 00 seconds east 440.00 feet to the
22 place of beginning.
23 Containing, within bounds, 2.307 acres of land, inclusive of
24 that area occupied by road and utilities right-of-way.
25 Being a part of the same premises, which the Board of
26 Trustees of the State Hospital for the Criminal Insane, acquired
27 by lawful condemnation, from Charles E. Keen, Ida C. Norris,
28 Nora L. Keen and James B. Keen, Jr., by proceedings and entries
29 as filed in the Office of the Clerk of the Court of Common Pleas
30 of Wayne County, Pennsylvania, under Docket No. 209, June Term
19830H1256B1474 - 2 -
1 1915.
2 The conveyance shall be made under and subject to all
3 easements, servitudes and rights of others, including but not
4 confined to streets, roadways and rights of any telephone,
5 telegraph, water, electric, sewer, gas or pipeline companies, as
6 well as under and subject to any interest, estates or tenancies
7 vested in third persons, whether or not appearing of record, for
8 any portion of the land or improvements erected thereon.
9 Section 2. The deed of conveyance shall contain a clause
10 that the lands conveyed shall be used for municipal purposes by
11 Canaan Township and if at any time the township or its successor
12 in function conveys said property or permits said property to be
13 used for any purpose other than those aforementioned, the title
14 thereto shall immediately revert to and revest in the
15 Commonwealth of Pennsylvania.
16 Section 3. The deed of conveyance shall be approved as
17 provided by law and shall be executed by the Secretary of
18 General Services in the name of the Commonwealth of
19 Pennsylvania.
20 Section 4. Costs and fees incidental to this conveyance
21 shall be borne by the grantee.
22 Section 5. This act shall take effect immediately.
