A SUPPLEMENT 1 To the act of July 7, 1972 (P.L.743, No.176), entitled "An act 2 providing for the establishment and operation of Lincoln 3 University as an instrumentality of the Commonwealth to serve 4 as a State-related institution in the higher education system 5 of the Commonwealth; providing for change of name; providing 6 for the composition of the board of trustees; terms of 7 trustees, and the power and duties of such trustees; 8 providing for preference to Pennsylvania residents in 9 tuition; authorizing appropriations in amounts to be fixed 10 annually by the General Assembly; providing for the auditing 11 of accounts of expenditures from said appropriations; 12 providing for public support and capital improvements; 13 authorizing the issuance of bonds exempt from taxation within 14 the Commonwealth; requiring the President to make an annual 15 report of the operations of Lincoln University," making 16 appropriations to Lincoln University; providing for a basis 17 for payments of the appropriations; and providing a method of 18 accounting for the funds appropriated. 19 The General Assembly of the Commonwealth of Pennsylvania 20 hereby enacts as follows: 21 Section 1. The following sums, or as much thereof as may be 22 necessary, are hereby appropriated to the Trustees of Lincoln 23 University, for the fiscal year July 1, 1983 to June 30, 1984, 24 for the following purposes and amounts:
1 (1) For educational and general expenses..... $4,272,000 <-- 2 (1) FOR EDUCATIONAL AND GENERAL EXPENSES AND <-- 3 FOR PARTICIPATION BY A REPRESENTATIVE OF THE 4 INSTITUTION, APPOINTED BY THE CHIEF EXECUTIVE 5 OFFICER THEREOF, AS A MEMBER OF THE PENNSYLVANIA 6 ACADEMIC COMMISSION ON TECHNOLOGICAL DEVELOPMENT, 7 A COMMISSION FOR INTER-INSTITUTIONAL COMMUNICA- 8 TION REGARDING TECHNOLOGICAL INNOVATION AND 9 DEVELOPMENT AND FOR DISSEMINATION OF INFORMATION 10 ON SUCH MATTERS TO THE PENNSYLVANIA BUSINESS 11 COMMUNITY AND OTHERS WHO MAY USE SUCH INFORMATION 12 FOR NEW BUSINESS AND JOB DEVELOPMENT IN PENNSYL- 13 VANIA, SUCH COMMISSION TO BE COMPOSED OF 14 REPRESENTATIVES OF EVERY STATE-OWNED OR STATE-RELATED 15 EDUCATIONAL OR SCIENTIFIC INSTITUTION 16 RECEIVING GENERAL FUND ASSISTANCE FROM THE 17 COMMONWEALTH..................................... $4,272,000 18 (2) For cost of student aid.................. 150,000 19 (3) For master's program in Human 20 Services................................. 190,000 21 (4) To enhance the recruitment and 22 retention of disadvantaged students...... 200,000 23 (5) To enhance the viability of the <-- 24 university, improve the quality of 25 education and student life, and increase 26 the opportunity for equal education at 27 Lincoln University....................... 1,000,000 28 (5) TO ENHANCE THE OPPORTUNITY FOR EQUAL <-- 29 EDUCATION AT LINCOLN UNIVERSITY IN 30 ACCORDANCE WITH THE PLAN SUBMITTED 19830H1026B1571 - 2 -
1 BY THE DEPARTMENT OF EDUCATION AND 2 APPROVED BY THE UNITED STATES OFFICE 3 OF CIVIL RIGHTS AND THE APPROPRIATION 4 TO BE MANAGED AND SUPERVISED BY THE 5 DEPARTMENT OF EDUCATION.................. 1,000,000 6 Section 2. Payments to Lincoln University on account of the 7 appropriations provided in section 1 shall be made on the basis 8 of costs during the fiscal period. 9 Section 3. (a) Payments to Lincoln University of the 10 appropriations provided in section 1 shall be made monthly 11 during the fiscal year. 12 (b) The monthly payments shall be made in accordance with 13 section 2 on the basis of estimated costs. The estimate of costs 14 shall be submitted by Lincoln University to the Secretary of 15 Education, the General Assembly and the State Treasurer not 16 later than 30 days prior to the date on which the payment is to 17 be made. 18 Section 4. (a) Lincoln University shall apply the moneys 19 appropriated by this act only for the purposes permitted in this 20 act and shall at all times maintain proper records showing the 21 application of the moneys. Not later than 120 days after the 22 close of the fiscal year to which this act relates, Lincoln 23 University shall file with the Secretary of Education, the 24 General Assembly and the Auditor General a statement setting 25 forth the amounts and purposes of all expenditures made from 26 moneys appropriated by this act and other university accounts 27 during the fiscal year, as provided in section 2, used as a 28 basis for receipt of any appropriation during the fiscal year. 29 (b) The statement of expenditures and costs shall be 30 reviewed by the Auditor General who has the right, in respect to 19830H1026B1571 - 3 -
1 the moneys appropriated by this act, to audit and disallow 2 expenditures made for purposes not permitted by this act and to 3 cause such sums to be recovered and paid by Lincoln University 4 to the State Treasurer. In respect to expenditures made by the 5 university from moneys other than those appropriated by this 6 act, the Auditor General has the right to review only and shall 7 file annually with the General Assembly any information 8 concerning these expenditures as the General Assembly or any of 9 its committees may require. 10 Section 5. A report shall be submitted to the Governor and 11 the Appropriations and Education Committees of the Senate and 12 House of Representatives and shall include data for all 13 programs. The report, to be submitted prior to September 1, 14 1984, shall cover the 12-month period beginning with the summer 15 term 1983 and shall include: 16 (1) The following counts and distributions for each term 17 during the period: 18 (i) The definitions and numbers of faculty members employed 19 full-time, of faculty members employed part-time, of full-time 20 students enrolled in graduate courses, of full-time students 21 enrolled in undergraduate courses, of part-time students 22 enrolled in graduate courses and of part-time students enrolled 23 in undergraduate courses. 24 (ii) The total numbers of undergraduate student credit 25 hours, divided into lower division and upper division course 26 levels and of graduate student credit hours divided into three 27 course levels: master's, first professional and doctoral. 28 (iii) The number of different courses scheduled by level of 29 instruction and the number of sections of individual instruction 30 at each level of instruction. 19830H1026B1571 - 4 -
1 (iv) The number of terms scheduled and the dates thereof. 2 (2) For the summer term and the following academic year in 3 total and for each two-digit Hegis category of instructional 4 programs in higher education as defined by the National Center 5 for Education Statistics, United States Department of Education, 6 a classification of faculty members or other professional 7 employees by title including: professor, associate professor, 8 assistant professor, instructor, lecturer, research associate, 9 librarian and academic administrator; faculty members or other 10 professional employees under each title to be subdivided by type 11 of assignment: teaching and nonteaching, with each set of 12 faculty members or other professional employees to be further 13 subdivided by type of employment: full-time or part-time and the 14 following aggregates for each subdivided classification: 15 (i) The number of faculty and other professional employees 16 and their full-time equivalence in instructional and 17 noninstructional functions. 18 (ii) The sum of credits assigned to undergraduate classroom 19 courses and the sum of credits assigned to graduate classroom 20 courses taught, divided into lower division, upper division, 21 master's, first professional and doctoral course levels. 22 (iii) The sum of credits assigned to undergraduate 23 individual instruction courses and the sum of credits assigned 24 to graduate individual instruction courses taught, divided into 25 lower division, upper division, master's, first professional and 26 doctoral course levels. 27 (iv) The sum of undergraduate classroom student credit hours 28 and the sum of graduate classroom student credit hours 29 generated; divided into lower division, upper division, 30 master's, first professional and doctoral course levels. 19830H1026B1571 - 5 -
1 (v) The sum of undergraduate individual instruction student 2 credit hours and the sum of graduate individual instruction 3 student credit hours generated; divided into lower division, 4 upper division, master's, first professional and doctoral course 5 levels. 6 (vi) The total salary paid for instructional functions and 7 for noninstructional functions and the amount of this salary 8 paid for each of these functions from college or university 9 funds, Federal funds and other funds. 10 (3) For each term of the period covered for each faculty 11 member employed full-time identified by two-digit Hegis category 12 and title, the report shall contain an analysis of the average 13 hours per week spent in college or university-related 14 activities, stating specifically hours spent in undergraduate 15 classroom contact and graduate classroom contact, hours spent in 16 preparation, hours spent in research and hours spent in public 17 service. 18 Section 6. (a) In addition to the requirements in section 5 19 relative to this appropriation, the report covering the 12-month 20 period beginning with the summer term 1983 shall include for all 21 programs of the university: 22 (1) The minimum number of credits required for a 23 baccalaureate degree and for a master's degree. 24 (2) The number of bachelor's degrees, master's degrees, 25 first professional degrees and doctoral degrees awarded in 1981, 26 1982, 1983 and estimated 1984. 27 (b) The Lincoln University shall report its revenues and 28 expenditures and present its financial statements required under 29 the provisions of this act in accordance with the "Higher 30 Education Finance Manual of 1975." 19830H1026B1571 - 6 -
1 Section 7. An additional report shall be submitted to the 2 Governor and the Appropriations and Education Committees of the 3 Senate and House of Representatives and shall include data which 4 indicates the increase in recruitment and retention activities 5 of Lincoln University relating to disadvantaged students and the 6 extent to which such activities have increased or will increase 7 disadvantaged student enrollment. 8 Section 8. The Lincoln University shall provide such 9 information as may be necessary to carry out the provisions of 10 this act and in the form and manner as the Department of 11 Education may prescribe. 12 Section 9. The Lincoln University shall report its revenues 13 and expenditures and present its financial statements required 14 under the provisions of this act in accordance with generally 15 accepted accounting principles and procedures for educational 16 institutions as set forth in the "Higher Education Finance 17 Manual of 1975," with the exceptions set forth in the 18 "Commonwealth of Pennsylvania Budget Instructions for State- 19 Related Universities, Phase I, Fiscal Year 1983-1984." Credits 20 granted for nontraditional programs such as CLEP, lifelong 21 learning etc., including all related costs and revenues thereof 22 shall be excluded from the function of "Instruction" and 23 included under "Public Service." 24 Section 10.
