A SUPPLEMENT
1 To the act of April 1, 1863 (P.L.213, No.227), entitled "An act
2 to accept the grant of Public Lands, by the United States, to
3 the several states, for the endowment of Agricultural
4 Colleges," making appropriations to Pennsylvania State
5 University; providing for a basis for payments of the
6 appropriations; and providing a method of accounting for the
7 funds appropriated.
8 The General Assembly of the Commonwealth of Pennsylvania
9 hereby enacts as follows:
10 Section 1. The following sums, or as much thereof as may be
11 necessary, are hereby appropriated to the Trustees of
12 Pennsylvania State University, for the fiscal year July 1, 1983
13 to June 30, 1984, for the following purposes and amounts:
14 (1) For educational and general expenses..... $109,041,000 <--

Payments to Pennsylvania State University on 12 account of the appropriations provided in section 1 shall be 13 made on the basis of costs during the fiscal year. 14 Section 3. If necessary, Pennsylvania State University may 15 transfer funds among the appropriations listed in section 1(1), 16 (2), (3), (5) and (6). The aggregate amount transferred into or 17 out of each appropriation during the fiscal year shall not 18 exceed 5% of the amount specifically appropriated for that 19 purpose. 20 Section 4. (a) Payments to Pennsylvania State University of 21 the appropriations provided in section 1 shall be made monthly 22 during the fiscal year. 23 (b) The monthly payments shall be made in accordance with 24 section 2 on the basis of estimated costs. The estimate of costs 25 shall be submitted by the Pennsylvania State University to the 26 Secretary of Education, the General Assembly and the State 27 Treasurer not later than 30 days prior to the date on which the 28 payment is to be made. 29 Section 5. Notwithstanding any provision of the General 30 Appropriation Act of 1983 relating to the payment of retirement 19830H1023B1228 - 2 -
1 expenses, the Trustees of Pennsylvania State University shall 2 make all required payments to the State Employees' Retirement 3 Fund from the funds appropriated pursuant to this act. 4 Section 6. (a) Pennsylvania State University shall apply 5 the moneys appropriated by this act only for the purposes 6 permitted in this act and shall at all times maintain proper 7 records showing the application of the moneys. Not later than 8 120 days after the close of the fiscal year to which this act 9 relates, Pennsylvania State University shall file with the 10 Secretary of Education, the General Assembly and the Auditor 11 General a statement setting forth the amounts and purposes of 12 all expenditures made from moneys appropriated by this act and 13 other university accounts during the fiscal year, as provided in 14 section 2, used as a basis for receipt of any appropriation 15 during the fiscal year. 16 (b) The statement of expenditures and costs shall be 17 reviewed by the Auditor General who has the right, in respect to 18 the moneys appropriated by this act, to audit and disallow 19 expenditures made for purposes not permitted by this act and to 20 cause such sums to be recovered and paid by Pennsylvania State 21 University to the State Treasurer. In respect to expenditures 22 made by the university from moneys other than those appropriated 23 by this act, the Auditor General has the right to review only 24 and shall file annually with the General Assembly any 25 information concerning these expenditures as the General 26 Assembly or any of its committees may require. 27 Section 7. A report shall be submitted to the Governor and 28 the Appropriations and Education Committees of the Senate and 29 House of Representatives and shall include data for all programs 30 except the Doctor of Medicine program. 1 submitted prior to September 1, 1984, shall cover the 12-month 2 period beginning with the summer term 1983 and shall include: 3 (1) The following counts and distributions for each term 4 during the period: 5 (i) The definitions and numbers of faculty members employed 6 full-time, of faculty members employed part-time, of full-time 7 students enrolled in graduate courses, of full-time students 8 enrolled in undergraduate courses, of part-time students 9 enrolled in graduate courses and of part-time students enrolled 10 in undergraduate courses. 11 (ii) The total numbers of undergraduate student credit 12 hours, divided into lower division and upper division course 13 levels and of graduate student credit hours divided into three 14 course levels: master's, first professional and doctoral. 15 (iii) The number of different courses scheduled by level of 16 instruction and the number of sections of individual instruction 17 at each level of instruction. 18 (iv) The number of terms scheduled and the dates thereof. 19 (2) For the summer term and the following academic year in 20 total and for each two-digit Hegis category of instructional 21 programs in higher education as defined by the National Center 22 for Education Statistics, United States Department of Education, 23 a classification of faculty members or other professional 24 employees by title including: professor, associate professor, 25 assistant professor, instructor, lecturer, research associate, 26 librarian and academic administrator; faculty members or other 27 professional employees under each title to be subdivided by type 28 of assignment: teaching and nonteaching, with each set of 29 faculty members or other professional employees to be further 30 subdivided by type of employment: full-time or part-time and the 19830H1023B1228 - 4 -
1 following aggregates for each subdivided classification: 2 (i) The number of faculty and other professional employees 3 and their full-time equivalence in instructional and 4 noninstructional functions. 5 (ii) The sum of credits assigned to undergraduate classroom 6 courses and the sum of credits assigned to graduate classroom 7 courses taught, divided into lower division, upper division, 8 master's, first professional and doctoral course levels. 9 (iii) The sum of credits assigned to undergraduate 10 individual instruction courses and the sum of credits assigned 11 to graduate individual instruction courses taught, divided into 12 lower division, upper division, master's, first professional and 13 doctoral course levels. 14 (iv) The sum of undergraduate classroom student credit hours 15 and the sum of graduate classroom student credit hours 16 generated; divided into lower division, upper division, 17 master's, first professional and doctoral course levels. 18 (v) The sum of undergraduate individual instruction student 19 credit hours and the sum of graduate individual instruction 20 student credit hours generated; divided into lower division, 21 upper division, master's, first professional and doctoral course 22 levels. 23 (vi) The total salary paid for instructional functions and 24 for noninstructional functions and the amount of this salary 25 paid for each of these functions from college or university 26 funds, Federal funds and other funds. 27 (3) For each term of the period covered for each faculty 28 member employed full-time identified by two-digit Hegis category 29 and title, the report shall contain an analysis of the average 30 hours per week spent in college or university-related 19830H1023B1228 - 5 -
1 activities, stating specifically hours spent in undergraduate 2 classroom contact and graduate classroom contact, hours spent in 3 preparation, hours spent in research and hours spent in public 4 service. 5 Section 8. (a) In addition to the requirements in section 7 6 relative to this appropriation, the report covering the 12-month 7 period beginning with the summer term 1983 shall include for all 8 programs of the university: 9 (1) The minimum number of credits required for a 10 baccalaureate degree and for a master's degree. 11 (2) The number of bachelor's degrees, master's degrees, 12 first professional degrees and doctoral degrees awarded in 1981, 13 1982, 1983 and estimated 1984. 14 (b) Pennsylvania State University shall report its revenues 15 and expenditures and present its financial statements required 16 under the provisions of this act in accordance with the "Higher 17 Education Finance Manual of 1975." 18 SECTION 9. AN ADDITIONAL REPORT SHALL BE SUBMITTED TO THE <-- 19 GOVERNOR AND THE APPROPRIATIONS AND EDUCATION COMMITTEES OF THE 20 SENATE AND HOUSE OF REPRESENTATIVES AND SHALL INCLUDE DATA WHICH 21 INDICATES THE INCREASE IN RECRUITMENT AND RETENTION ACTIVITIES 22 OF THE PENNSYLVANIA STATE UNIVERSITY RELATING TO MINORITY 23 STUDENTS AND FACULTY AND THE EXTENT TO WHICH SUCH ACTIVITIES 24 HAVE INCREASED OR WILL INCREASE MINORITY STUDENT ENROLLMENT AND 25 MINORITY FACULTY PARTICIPATION. 26 Section 9 10. Pennsylvania State University shall provide <-- 27 such information as may be necessary to carry out the provisions 28 of this act and in the form and manner as the Department of 29 Education may prescribe. 30 Section 10 11. Pennsylvania State University shall report <-- 19830H1023B1228 - 6 -
1 its revenues and expenditures and present its financial
2 statements required under the provisions of this act in
3 accordance with generally accepted accounting principles and
4 procedures for educational institutions as set forth in the
5 "Higher Education Finance Manual of 1975," with the exceptions
6 set forth in the "Commonwealth of Pennsylvania Budget
7 Instructions for State Related Universities, Phase I, Fiscal
8 Year 1983-1984." Credits granted for nontraditional programs
9 such as CLEP, lifelong learning etc., including all related
10 costs and revenues thereof shall be excluded from the function
11 of "Instruction" and included under "Public Service."
12 Section 11 12. This act shall take effect July 1, 1983 or, <--
13 if enacted subsequent to that date, then immediately.
