AN ACT 1 Amending Title 42 (Judiciary and Judicial Procedure) of the 2 Pennsylvania Consolidated Statutes, further providing for the 3 crime victims' compensation fund. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Title 42 of the Pennsylvania Consolidated 7 Statutes is amended by adding a section to read: 8 § 1725.3. Mandatory costs. 9 Any person who pleads guilty or nolo contendere or who is 10 convicted of any crime, as defined in section 477 of the act of 11 April 9, 1929 (P.L.177, No.175), known as The Administrative 12 Code of 1929, shall be sentenced to pay costs of AT LEAST $15 of <-- 13 which $10 shall be paid into a special nonlapsing fund, which is 14 hereby established, for use by the Crime Victim's Compensation
1 Board for payment to victims and of which $5 shall be paid into 2 a special nonlapsing fund, which is hereby established, for use 3 by the Commission on Crime and Delinquency for reimbursement to <-- 4 counties for victim-witness services GRANTS in accordance with <-- 5 the act of (P.L. , No. ), known as the Crime 6 Victim's Bill of Rights. This cost shall be imposed 7 notwithstanding any other provision of this title or other 8 statute to the contrary. 9 Section 2. The district attorney, the Crime Victim's 10 Compensation Board or any victim of a crime (as defined in 11 section 477.1 of the act of April 9, 1929 (P.L.177, No.175), 12 known as The Administrative Code of 1929), shall have standing 13 to seek a mandamus order requiring the county to collect the 14 costs imposed by this section. 15 Section 3. Section 3571(d) of Title 42 is repealed INSOFAR <-- 16 AS IT IMPOSES COSTS IN ADDITION TO THE COSTS PROVIDED FOR IN 17 SECTION 1725.3. 18 Section 4. This act shall apply to crimes committed after 19 the effective date. 20 Section 5. This act shall take effect in 60 days. C31L42RAW/19830H0825B2860 - 2 -
