AN ACT 1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania 2 Consolidated Statutes, further providing for institutional 3 vandalism. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 3307 of Title 18 of the Pennsylvania 7 Consolidated Statutes is amended to read: 8 § 3307. Institutional vandalism. 9 (a) Offenses defined.--A person commits the offense of 10 institutional vandalism if he knowingly desecrates, as defined 11 in section 5509 (relating to desecration of venerated objects), 12 vandalizes, defaces or otherwise damages: 13 (1) any church, synagogue or other facility or place 14 used for religious worship or other religious purposes; 15 (2) any cemetery, mortuary or other facility used for 16 the purpose of burial or memorializing the dead; 17 (3) any school, educational facility [or], community 18 center, juvenile detention center, county or State prison;
1 (4) the grounds adjacent to and owned or occupied by any 2 facility set forth in paragraph (1), (2) or (3); or 3 (5) any personal property located in any facility set 4 forth in paragraph (1), (2) or (3). 5 (b) Grading.--An offense under this section is a felony of 6 the third degree if the actor causes pecuniary loss in excess of 7 $5,000. Pecuniary loss includes the cost of repair or 8 replacement of the property affected. Otherwise, institutional 9 vandalism is a misdemeanor of the second degree. 10 Section 2.
