AN ACT 1 Amending the act of June 18, 1974 (P.L.359, No.120), entitled 2 "An act creating the Municipal Police Officers' Education and 3 Training Commission; providing for the commission's 4 membership, selection, compensation, and removal; providing 5 for the powers and duties of the commission; providing for 6 the appointment and duties of the chairman; providing for the 7 act's applicability to the civil service laws; requiring 8 training by certain political subdivisions and police 9 departments; providing penalties for violation thereof; and 10 making an appropriation," extending the length of time to 11 complete training; and further providing for reimbursement of 12 certain expenses. 13 The General Assembly of the Commonwealth of Pennsylvania 14 hereby enacts as follows: 15 Section 1. Section 9 10 of the act of June 18, 1974 <-- 16 (P.L.359, No.120), referred to as the Municipal Police Education 17 and Training Law, is amended BY ADDING A SUBSECTION to read: <-- 18 Section 9. Police Training Mandatory; Penalties.--All <-- 19 political subdivisions of the Commonwealth or groups of 20 political subdivisions acting in concert shall be required to 21 train all members of their police departments hired by them
1 after the effective date of this act, pursuant to the provisions 2 of this act. 3 Any person hired as a municipal police officer by any 4 political subdivision or group thereof acting in concert after 5 the effective date of this act shall be at the end of [one year] 6 two years from the date of his employment ineligible to receive 7 any salary, compensation or other consideration or thing of 8 value for the performance of his duties as a police officer 9 unless he has met all of the requirements as established by the 10 Municipal Police Officers' Education and Training Commission and 11 has been duly certified as having met those requirements by the 12 commissioner, unless the police officer is granted additional 13 time to complete his training by the commissioner. However, such 14 persons hired as a municipal police officer will be given a 15 grace period of two years from the effective date of this act 16 before he becomes ineligible to receive salary, compensation or 17 other consideration of thing of value. 18 Any official of any political subdivision who orders, 19 authorizes or pays as salary to a person in violation of the 20 provisions of this act shall on summary conviction thereof be 21 sentenced to pay a fine of one hundred dollars ($100) or be 22 imprisoned for a term not to exceed a period of thirty days. 23 Section 2. Section 10 of the act is amended by adding a 24 subsection to read: 25 Section 10. Reimbursement of Expenses.--* * * 26 (d) If a police officer, within two years following 27 certification, terminates his employment with the political 28 subdivision by which he was employed at the time he was duly 29 certified as having met the commission's requirement and 30 thereafter obtains employment as a police officer with another 19830H0729B3504 - 2 -
1 political subdivision, the political subdivision which employs 2 the previously certified police officer shall reimburse the 3 political subdivision which formerly employed the police officer 4 for the nonreimbursable portion of the salary paid to the police 5 officer while complying with the provisions of this act. 6 Section 3 2.
