        AS REPORTED FROM COMMITTEE ON LOCAL GOVERNMENT, HOUSE OF
           REPRESENTATIVES, AS AMENDED, MAY 8, 1984

                                     AN ACT

     1  Amending the act of June 18, 1974 (P.L.359, No.120), entitled
     2     "An act creating the Municipal Police Officers' Education and
     3     Training Commission; providing for the commission's
     4     membership, selection, compensation, and removal; providing
     5     for the powers and duties of the commission; providing for
     6     the appointment and duties of the chairman; providing for the
     7     act's applicability to the civil service laws; requiring
     8     training by certain political subdivisions and police
     9     departments; providing penalties for violation thereof; and
    10     making an appropriation," extending the length of time to
    11     complete training; and authorizing certain police departments  <--
    12     to conduct training as approved schools. COMPLETE TRAINING;    <--
    13     AND FURTHER PROVIDING FOR REIMBURSEMENT OF CERTAIN EXPENSES.

    14     The General Assembly of the Commonwealth of Pennsylvania
    15  hereby enacts as follows:
    16     Section 1.  Section 6 9 of the act of June 18, 1974 (P.L.359,  <--
    17  No.120), referred to as the Municipal Police Education and
    18  Training Law, is amended by adding a clause to read:              <--
    19     Section 6.  Powers and Duties of the Commissioner.--The        <--
    20  duties of the commissioner shall be as follows:
    21     * * *
    22     (10)  To certify as an approved school, any police department


     1  having five or more full-time police officers, if in the opinion
     2  of the commissioner, the department has the capabilities to
     3  perform most of the training requirements imposed on an approved
     4  school pursuant to the provisions of this act and the
     5  implementing regulations.
     6     Section 2.  Section 9 of the act is amended to read:
     7     Section 9.  Police Training Mandatory; Penalties.--All
     8  political subdivisions of the Commonwealth or groups of
     9  political subdivisions acting in concert shall be required to
    10  train all members of their police departments hired by them
    11  after the effective date of this act, pursuant to the provisions
    12  of this act.
    13     Any person hired as a municipal police officer by any
    14  political subdivision or group thereof acting in concert after
    15  the effective date of this act shall be at the end of [one year]
    16  two years from the date of his employment ineligible to receive
    17  any salary, compensation or other consideration or thing of
    18  value for the performance of his duties as a police officer
    19  unless he has met all of the requirements as established by the
    20  Municipal Police Officers' Education and Training Commission and
    21  has been duly certified as having met those requirements by the
    22  commissioner, unless the police officer is granted additional
    23  time to complete his training by the commissioner. However, such
    24  persons hired as a municipal police officer will be given a
    25  grace period of two years from the effective date of this act
    26  before he becomes ineligible to receive salary, compensation or
    27  other consideration of thing of value.
    28     Any official of any political subdivision who orders,
    29  authorizes or pays as salary to a person in violation of the
    30  provisions of this act shall on summary conviction thereof be

     1  sentenced to pay a fine of one hundred dollars ($100) or be
     2  imprisoned for a term not to exceed a period of thirty days.
     3     SECTION 2.  SECTION 10 OF THE ACT IS AMENDED BY ADDING A       <--
     4  SUBSECTION TO READ:
     5     SECTION 10.  REIMBURSEMENT OF EXPENSES.--* * *
     6     (D)  IF A POLICE OFFICER, WITHIN TWO YEARS FOLLOWING
     7  CERTIFICATION, TERMINATES HIS EMPLOYMENT WITH THE POLITICAL
     8  SUBDIVISION BY WHICH HE WAS EMPLOYED AT THE TIME HE WAS DULY
     9  CERTIFIED AS HAVING MET THE COMMISSION'S REQUIREMENT AND
    10  THEREAFTER OBTAINS EMPLOYMENT AS A POLICE OFFICER WITH ANOTHER
    11  POLITICAL SUBDIVISION, THE POLITICAL SUBDIVISION WHICH EMPLOYS
    12  THE PREVIOUSLY CERTIFIED POLICE OFFICER SHALL REIMBURSE THE
    13  POLITICAL SUBDIVISION WHICH FORMERLY EMPLOYED THE POLICE OFFICER
    14  FOR THE NONREIMBURSABLE PORTION OF THE SALARY PAID TO THE POLICE
    15  OFFICER WHILE COMPLYING WITH THE PROVISIONS OF THIS ACT.
    16     Section 3.  This act shall take effect immediately.
