                                     AN ACT

     1  Amending the act of April 5, 1849 (P.L.397, No.296), entitled
     2     "An act to prevent the opening of streets or public roads
     3     through burial grounds, and for the protection of cemeteries
     4     and grave yards," prohibiting the opening of highways through
     5     cemeteries in Philadelphia.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 1 of the act of April 5, 1849 (P.L.397,
     9  No.296), entitled "An act to prevent the opening of streets or
    10  public roads through burial grounds, and for the protection of
    11  cemeteries and grave yards," is amended to read:
    12     Section 1.  Be it enacted by the Senate and House of
    13  Representatives of the Commonwealth of Pennsylvania in General
    14  Assembly met, and it is hereby enacted by the authority of the
    15  same. That hereafter it shall not be lawful to open any street,
    16  lane, alley or public road through any burial ground or cemetery
    17  within this Commonwealth, any laws heretofore passed to the
    18  contrary notwithstanding[: Provided, That this section shall not
    19  extend to the City and County of Philadelphia].

     1     Section 2.  This act shall take effect immediately.
