AN ACT
1 Amending the act of May 17, 1956 (1955 P.L.1609, No.537),
2 entitled "An act to promote the welfare of the people of the
3 Commonwealth by the reduction of unemployment in certain
4 areas of the Commonwealth determined to be critical economic
5 areas; providing for the establishment of industrial
6 development projects in such areas; creating The Pennsylvania
7 Industrial Development Authority as a body corporate and
8 politic with power to allocate funds for and make secured
9 loans to industrial development agencies for the payment of a
10 part of the cost of industrial development projects in
11 critical economic areas; authorizing the Authority to enter
12 into agreements with the Government of the United States or
13 any Federal agency or industrial development agency;
14 empowering the Authority to take title to, sell, convey and
15 lease industrial development projects where necessary to
16 protect loans made by the Pennsylvania Industrial Development
17 Authority on industrial development projects; providing that
18 no debt of the Commonwealth, its municipalities or political
19 subdivisions shall be incurred in the exercise of any powers
20 granted by this act; and providing for the examination of the
21 accounts and affairs of the Authority; and making an
22 appropriation," providing preferential Pennsylvania
23 Industrial Development Authority loans for coal projects. THE <--
24 USE OF COAL, OIL OR GAS PRODUCED IN PENNSYLVANIA.
25 The General Assembly of the Commonwealth of Pennsylvania
26 hereby enacts as follows:
27 Section 1. The act of May 17, 1956 (1955 P.L.1609, No.537),
1 known as the Pennsylvania Industrial Development Authority Act, 2 is amended by adding a section to read: 3 Section 6.1. Powers of the Authority; Encouragement of Coal <-- 4 Use USE OF PENNSYLVANIA PRODUCED COAL, OIL OR GAS.--(A) An <-- 5 application which meets all the other requirements of this act 6 shall be given a preference over other applications WHICH <-- 7 EQUALLY SATISFY ALL OF THE COMPETITIVE CRITERIA FOR A LOAN if it 8 is for an industrial development project involving: 9 (a) (1) The construction of a facility if the facility would <-- 10 burn coal USE COAL, OIL OR GAS; a synthetic fuel derived in <-- 11 whole or in part from coal, OIL OR GAS; or a mixture which <-- 12 includes coal or is derived in whole or in part from coal ANY <-- 13 ONE OF THOSE ELEMENTS, either to heat the facility or as part of 14 the industrial process carried out in the facility; 15 (b) (2) The expansion of a facility if the expanded portion <-- 16 of the facility would burn coal USE COAL, OIL OR GAS; a <-- 17 synthetic fuel derived in whole or in part from coal, OIL OR <-- 18 GAS; or a mixture which includes coal or is derived in whole or <-- 19 in part from coal ANY ONE OF THOSE ELEMENTS, either to heat the <-- 20 expanded portion of the facility or as part of the industrial 21 process carried out in the expanded portion of the facility; or 22 (c) (3) The renovation of a facility if, because of the <-- 23 renovation, the facility would burn coal USE COAL, OIL OR GAS; a <-- 24 synthetic fuel derived in whole or in part from coal, OIL OR <-- 25 GAS; or a mixture which includes coal or is derived in whole or <-- 26 in part from coal ANY ONE OF THOSE ELEMENTS, either to heat the <-- 27 renovated facility or as part of the industrial process carried 28 out in the renovated facility. 29 (B) Whenever the board of the Authority grants a loan for <-- 30 such an industrial development project, the interest rate on <-- 19830H0332B1326 - 2 -
1 such loan shall be at a rate which shall be (1%) per annum less 2 than the rate of interest the board would otherwise have 3 established for such loan IF IT IS FOR AN INDUSTRIAL DEVELOPMENT <-- 4 PROJECT INVOLVING: 5 (1) THE CONSTRUCTION OF A FACILITY IF THE FACILITY WOULD 6 BURN COAL; A SYNTHETIC FUEL DERIVED IN WHOLE OR IN PART FROM 7 COAL; OR A MIXTURE WHICH INCLUDES COAL OR IS DERIVED IN WHOLE OR 8 IN PART FROM COAL, EITHER TO HEAT THE FACILITY OR AS PART OF THE 9 INDUSTRIAL PROCESS CARRIED OUT IN THE FACILITY; 10 (2) THE EXPANSION OF A FACILITY IF THE EXPANDED PORTION OF 11 THE FACILITY WOULD BURN COAL; A SYNTHETIC FUEL DERIVED IN WHOLE 12 OR IN PART FROM COAL; OR A MIXTURE WHICH INCLUDES COAL OR IS 13 DERIVED IN WHOLE OR IN PART FROM COAL, EITHER TO HEAT THE 14 EXPANDED PORTION OF THE FACILITY OR AS PART OF THE INDUSTRIAL 15 PROCESS CARRIED OUT IN THE EXPANDED PORTION OF THE FACILITY; OR 16 (3) THE RENOVATION OF A FACILITY IF, BECAUSE OF THE 17 RENOVATION, THE FACILITY WOULD BURN COAL; A SYNTHETIC FUEL 18 DERIVED IN WHOLE OR IN PART FROM COAL, OR A MIXTURE WHICH 19 INCLUDES COAL OR IS DERIVED IN WHOLE OR IN PART FROM COAL, 20 EITHER TO HEAT THE RENOVATED FACILITY OR AS PART OF THE 21 INDUSTRIAL PROCESS CARRIED OUT IN THE RENOVATED FACILITY. 22 (C) For the purpose of this section "coal" means coal <-- 23 produced from Pennsylvania mines. "COAL, OIL OR GAS" MEANS COAL, <-- 24 OIL OR GAS PRODUCED IN PENNSYLVANIA OR ANY MIXTURE OF COAL, OIL 25 OR GAS OR DERIVATIVE THEREFROM WHICH HAS BEEN PRODUCED IN 26 PENNSYLVANIA. 27 Section 2.
