                                     AN ACT

     1  Amending the act of August 26, 1971 (P.L.351, No.91), entitled
     2     "An act providing for a State Lottery and administration
     3     thereof; authorizing the creation of a State Lottery
     4     Commission; prescribing its powers and duties; disposition of
     5     funds; violations and penalties therefor; exemption of prizes
     6     from State and local taxation and making an appropriation,"
     7     providing for off-track pari-mutuel wagering; and
     8     establishing the Off-track Wagering Fund for educational
     9     purposes.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Section 1 of the act of August 26, 1971 (P.L.351,
    13  No.91), known as the State Lottery Law, is amended to read:
    14     Section 1.  Short Title.--This act shall be known and may be
    15  cited as the "State Lottery and Off-track Wagering Law."
    16     Section 2.  The act is amended by adding sections to read:
    17     Section 15.1.  Off-track Pari-mutuel Wagering.--(a)  The
    18  commission shall by rule establish a system of off-track pari-
    19  mutuel wagering on horse and harness races conducted at tracks
    20  operating under the act of December 17, 1981 (P.L.435, No.135),
    21  known as the Race Horse Industry Reform Act, except races

     1  conducted at county and political subdivision agricultural and
     2  other fairs.
     3     (b)  The wagering system adopted by the commission shall be
     4  substantially similar to the system provided for in the above
     5  cited statute, insofar as is practicable. Off-track wagering
     6  shall be conducted through all lottery sales agents.
     7     Section 15.2.  Off-track Wagering Fund.--There is hereby
     8  established a fund in the State Treasury to be known as the
     9  "Off-track Wagering Fund," separate and apart from all other
    10  public moneys of the Commonwealth. All profits realized from
    11  off-track wagering shall be paid into this fund by the
    12  commission. Moneys in the fund shall be used only for
    13  educational purposes by the Department of Education, as the
    14  General Assembly shall from time to time appropriate.
    15     Section 3.  The commission shall begin off-track wagering
    16  within one year of the date of final enactment.
    17     Section 4.  This act shall take effect immediately.
