AN ACT
1 Authorizing and directing the Department of General Services and
2 the Pennsylvania Department of Agriculture with the approval
3 of the Governor, to convey to the Danville Area School
4 District, 11.80 acres of land, more or less, situate in the
5 Borough of Danville, Montour County, Commonwealth of
6 Pennsylvania.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. The Department of General Services and the
10 Pennsylvania Department of Agriculture, with the approval of the
11 Governor, is hereby authorized and directed on behalf of the
12 Commonwealth of Pennsylvania, to grant and convey for a
13 consideration of one-half of fair market value to the Danville
14 Area School District, described in accordance with a plan
15 prepared for the Danville Area School District, dated January
16 1982, as prepared by Peter J. Uhle, Registered Surveyor, 708
17 East Front Street, Danville, Pennsylvania and the following
18 tract of land situate in the Danville Area School District,
19 Montour County, and Commonwealth of Pennsylvania, bounded and
1 described as follows:
2 Beginning at a concrete monument, said monument being the
3 southeast corner of the described tract of land and also being
4 the northeast corner of lands of the cemetery; thence along
5 lands of the cemetery north 80 degrees 38 minutes west 607.37
6 feet to a concrete monument; thence along lands of the Danville
7 Area School District north 9 degrees 13 minutes east 850.64 feet
8 to an iron pin; thence along United States Route 11 south 83
9 degrees 42 minutes east 465.93 feet to an iron pin; thence along
10 lands of the grantor south 56 degrees 45 minutes east 136.88
11 feet to an iron pin; thence along the same south 07 degrees 32
12 minutes west 125.25 feet to an iron pin; thence along the same
13 south 08 degrees 02 minutes west 692.96 feet to the place of
14 beginning. Containing 11.80 acres.
15 The conveyance shall be made under and subject to all
16 easements, servitudes and rights of others, including but not
17 confined to streets, roadways and rights of any telephone,
18 telegraph, water, electric, sewer, gas or pipeline companies, as
19 well as under and subject to any interest, estates or tenancies
20 vested in third persons, whether or not appearing of record, for
21 any portion of the land or improvements erected thereon.
22 Section 2. The purchase price of one-half of fair market
23 value shall be paid to the Commonwealth over a 20-year period in
24 equal annual installments commencing on January 15 of the year
25 following the effective date of this act and each year
26 thereafter.
27 Section 3. The Deed of Conveyance shall contain a clause
28 that the lands conveyed shall be used for scholastic and
29 recreational purposes by the Danville Area School District and
30 if at any time the said Danville Area School District or its

1 successor in function conveys said property or permits said
2 property to be used for any purpose other than those
3 aforementioned, the title thereto shall immediately revert to
4 and revest in the Commonwealth of Pennsylvania.
5 Section 4. The Deed of Conveyance shall be approved as
6 provided by law and shall be executed by the Secretary of
7 General Services in the name of the Commonwealth of
8 Pennsylvania.
9 Section 5. Costs and fees incidental to this conveyance
10 shall be borne by the grantee.
11 Section 6. This act shall take effect immediately.
