A SUPPLEMENT 1 To the act of July 28, 1966 (3rd Sp.Sess., P.L.87, No.3), 2 entitled "An act providing for the establishment and 3 operation of the University of Pittsburgh as an 4 instrumentality of the Commonwealth to serve as a State- 5 related university in the higher education system of the 6 Commonwealth; providing for change of name; providing for the 7 composition of the board of trustees; terms of trustees, and 8 the power and duties of such trustees; authorizing 9 appropriations in amounts to be fixed annually by the General 10 Assembly; providing for the auditing of accounts of 11 expenditures from said appropriations; providing for public 12 support and capital improvements; authorizing the issuance of 13 bonds exempt from taxation within the Commonwealth; requiring 14 the chancellor to make an annual report of the operations of 15 the University of Pittsburgh," making appropriations for 16 carrying the same into effect, providing for a basis for 17 payments of such appropriations, and providing a method of 18 accounting for the funds appropriated. 19 The General Assembly of the Commonwealth of Pennsylvania 20 hereby enacts as follows: 21 Section 1. The following sums, or as much thereof as may be 22 necessary, are hereby specifically appropriated to the Trustees 23 of the University of Pittsburgh for the fiscal year July 1, 1981 24 to June 30, 1982, for the purpose and in the amounts as shown: 25 (1) For educational and general expenses..... $66,410,000
1 (2) For operations of the Titusville Campus.. 500,000 2 (3) For cost of student aid.................. 2,960,000 3 (4) For instruction - Doctor of Medicine 4 only........................................ 4,083,000 5 (5) For operation of dental clinics in the 6 school of dentistry......................... 600,000 7 Section 2. (a) Payments to the University of Pittsburgh on 8 account of the appropriations for all items, as provided in 9 section 1 except for instruction - Doctor of Medicine shall be 10 made on the basis of costs during the fiscal year. 11 (b) Payments for instruction - Doctor of Medicine shall be 12 made on the basis of full-time student enrollment at a rate not 13 to exceed $7,465 per student. 14 Section 3. If necessary the University of Pittsburgh may 15 transfer funds between the appropriations listed in section 1, 16 paragraphs (1) and (2): Provided, That the aggregate amount 17 transferred into or out of each appropriation during the fiscal 18 year shall not exceed 5% of the amount specifically appropriated 19 for that purpose. 20 Section 4. (a) Payments to the University of Pittsburgh of 21 the appropriations herein provided shall be made monthly during 22 the fiscal year. 23 (b) Such monthly payments shall be made in accordance with 24 the provisions of section 2 on the basis of estimated costs and 25 full-time students enrolled in the Doctor of Medicine program. 26 The estimate of costs shall be submitted by the University of 27 Pittsburgh to the Secretary of Education, the General Assembly 28 and to the Treasurer of the Commonwealth not later than 30 days 29 prior to the date on which such payment is to be made. 30 Section 5. (a) The University of Pittsburgh shall apply the 19810S0854B0931 - 2 -
1 moneys appropriated by this act only for such purposes as are 2 permitted in this act and shall at all times maintain proper 3 records showing the application of such moneys. Not later than 4 120 days after the close of the fiscal year to which this act 5 relates, the University of Pittsburgh shall file with the 6 Secretary of Education, the General Assembly, the Auditor 7 General of the Commonwealth and the chief administrator of each 8 branch campus, a statement setting forth the amounts and 9 purposes of all expenditures made from moneys appropriated by 10 this act and other university accounts during said fiscal year, 11 the number of full-time students enrolled in the Doctor of 12 Medicine program and costs, as provided in section 2, used as a 13 basis for receipt of any appropriation during said fiscal year. 14 (b) Such statement of expenditures, and number of full-time 15 students enrolled in the Doctor of Medicine program and costs 16 shall be reviewed by the Auditor General of the Commonwealth, 17 and he shall have the right, in respect to the moneys 18 appropriated by this act, to audit and disallow expenditures 19 made for purposes not permitted by this act and to cause such 20 sums to be recovered and paid by the University of Pittsburgh to 21 the Treasurer of the Commonwealth. The Auditor General shall 22 also make a determination of full-time students enrolled in the 23 Doctor of Medicine program and costs and make a certification as 24 to their correctness. In respect to expenditures made by the 25 university from moneys other than those appropriated by this 26 act, the Auditor General shall have the right to review only and 27 he shall file annually with the General Assembly such 28 information concerning such expenditures as the General Assembly 29 or any of its committees may require. 30 Section 6. A report shall be submitted to the Governor and 19810S0854B0931 - 3 -
1 the Appropriations and Education Committees of the Senate and 2 House of Representatives and shall include data for all programs 3 except the Doctor of Medicine program. The report, to be 4 submitted prior to September 1, 1982, shall cover the 12-month 5 period beginning with the summer term 1981 and shall include: 6 (1) The following counts and distributions for each term 7 during the period: 8 (i) The definitions and numbers of faculty members employed 9 full-time, of faculty members employed part-time, of full-time 10 students enrolled in graduate courses, of full-time students 11 enrolled in undergraduate courses, of part-time students 12 enrolled in graduate courses and of part-time students enrolled 13 in undergraduate courses. 14 (ii) Total numbers of undergraduate student credit hours, 15 divided into lower division and upper division course levels and 16 of graduate student credit hours divided into three course 17 levels--master's, first professional and doctoral. 18 (iii) Number of different courses scheduled by level of 19 instruction and the number of sections of individual instruction 20 at each level of instruction. 21 (iv) Number of terms scheduled and the dates thereof. 22 (2) For the summer term and the following academic year in 23 total and for each two-digit Hegis category of instructional 24 programs in higher education as defined by the National Center 25 for Education Statistics, United States Department of Education, 26 a classification of faculty members or other professional 27 employees by title including: professor, associate professor, 28 assistant professor, instructor, lecturer, research associate, 29 librarian and academic administrator; faculty members or other 30 professional employees under each title to be subdivided by type 19810S0854B0931 - 4 -
1 of assignment: teaching and nonteaching, and each such set of 2 faculty members or other professional employees to be further 3 subdivided by type of employment: full-time or part-time and the 4 following aggregates for each such subdivided classification: 5 (i) The number of faculty and other professional employees 6 and their full-time equivalence in instructional and 7 noninstructional functions. 8 (ii) The sum of credits assigned to undergraduate classroom 9 courses and the sum of credits assigned to graduate classroom 10 courses taught, divided into lower division, upper division, 11 master's, first professional and doctoral course levels. 12 (iii) The sum of undergraduate classroom student credit 13 hours and the sum of graduate classroom student credit hours 14 generated; divided into lower division, upper division, master's 15 first professional and doctoral course levels. 16 (iv) The sum of undergraduate individual instruction student 17 credit hours and the sum of graduate individual instruction 18 student credit hours generated; divided into lower division, 19 upper division, master's, first professional and doctoral course 20 levels. 21 (v) Total salary paid for instructional functions and for 22 noninstructional functions and the amount of this salary paid 23 for each of these functions from college or university funds, 24 Federal funds and other funds. 25 (3) For each term of the period covered for each faculty 26 member employed full-time identified by two-digit Hegis category 27 and title, the report shall contain an analysis of the average 28 hours per week spent in college or university-related 29 activities, stating specifically hours spent in undergraduate 30 classroom contact and graduate classroom contact, hours spent in 19810S0854B0931 - 5 -
1 preparation, hours spent in research and hours spent in public 2 service. 3 Section 7. (a) In addition to the above requirements 4 relative to this appropriation, the report covering the 12-month 5 period beginning with the summer term 1981, shall include for 6 all programs of the university: 7 (1) Minimum number of credits required for a baccalaureate 8 degree and for a master's degree. 9 (2) Number of bachelor's degrees, master's degrees, first 10 professional degrees and doctoral degrees awarded in 1979, 1980, 11 1981 and estimated 1982. 12 (b) The university shall report its revenues and 13 expenditures and present its financial statements required under 14 the provisions of this act in accordance with "Higher Education 15 Finance Manual" (1975). 16 Section 8. The university shall provide such information as 17 may be necessary to carry out the provisions of this act and in 18 such form and manner as the Department of Education may 19 prescribe. 20 Section 9. The university shall report its revenues and 21 expenditures and present its financial statements required under 22 the provisions of this act in accordance with generally accepted 23 accounting principles and procedures for educational 24 institutions as set forth in "Higher Education Finance Manual" 25 United States Department of Health, Education and Welfare (1975) 26 with the exceptions set forth in the Commonwealth of 27 Pennsylvania Budget Instructions for State Related Universities, 28 Phase I, Fiscal Year 1981-1982. Credits granted for 29 nontraditional programs such as CLEP, lifelong learning etc., 30 including all related costs and revenues thereof shall be 19810S0854B0931 - 6 -
1 excluded from the function of "Instruction" and included under 2 "Public Service." 3 Section 10. In addition to the requirements of section 6, 4 the University of Pittsburgh shall, by March 1, 1982, submit to 5 the Appropriations and Education Committees of the Senate and 6 the House of Representatives a breakdown of the funds budgeted 7 for this fiscal year for the main campus and each branch campus 8 including expenditures budgeted from this act and expenditures 9 budgeted from moneys other than those appropriated by this act. 10 Section 11.
