                                     AN ACT

     1  Amending the act of June 30, 1965 (P.L.153, No.103), entitled
     2     "An act to create a regional agency by intergovernmental
     3     compact for the continuing, comprehensive, coordinated
     4     regional planning for the Delaware Valley Urban Area, and
     5     defining the functions, powers and duties of such agency,"
     6     providing for the appointment of legislative members to the
     7     commission.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Sections 2 and 4 and subsections (a) and (b) of
    11  section 9 of Article II, act of June 30, 1965 (P.L.153, No.103),
    12  known as the "Delaware Valley Urban Area Compact," reenacted and
    13  amended June 30, 1967 (P.L.155, No.43), are amended to read:
    14                             ARTICLE II
    15                    Organization and Membership
    16     * * *
    17     Section 2.  Commission Membership.--The commission shall
    18  consist of the following members to be known as commissioners:
    19     The Secretary of [Highways] Transportation of the
    20  Commonwealth of Pennsylvania, ex officio,

     1     The Commissioner of Transportation of the State of New
     2  Jersey, ex officio,
     3     The Executive Director, State Planning Board, Commonwealth of
     4  Pennsylvania, ex officio,
     5     The Commissioner of Community Affairs, State of New Jersey,
     6  ex officio,
     7     An appointee of the Governor of Pennsylvania, by and with the
     8  consent of the Senate, who shall be a resident of Pennsylvania
     9  and the area, and shall serve at the pleasure of the Governor,
    10     An appointee of the Governor of New Jersey who shall be a
    11  resident of New Jersey and the area, and shall serve at the
    12  pleasure of the Governor,
    13     Two legislative members from New Jersey, one from the House
    14  of Representatives and one from the Senate, each to be appointed
    15  by the presiding officer,
    16     Two legislative members from Pennsylvania, one from the House
    17  of Representatives and one from the Senate, each to be appointed
    18  by the presiding officer,
    19     A representative from each of the four Pennsylvania counties
    20  and four New Jersey counties included in the area, [and]
    21     One representative each from the Cities of Philadelphia,
    22  Chester, Camden and Trenton.
    23     Section 4.  Voting Power.--A quorum of the commission for the
    24  purpose of transacting business at any commission meeting shall
    25  exist only when there are present, in person, at least [five]
    26  seven members or alternates from each of the party states
    27  including at least [two of three] three of five state officials
    28  or appointees or their alternates from each state. No action of
    29  the commission shall be effective or binding unless a majority
    30  of each party state's representatives who are present at such

     1  meeting, including at least [two of the three] three of the five
     2  state's officials or appointees or their alternates, shall vote
     3  in favor thereof.
     4     Section 9.  Executive Committee; Meetings, Powers and
     5  Duties.--(a)  The Executive Committee of the Delaware Valley
     6  Regional Planning Commission shall consist of the following
     7  commissioners:
     8     The four ex officio members or their alternates,
     9     The two appointees of the Governors,
    10     The four legislative appointees,
    11     One representative to be chosen by the four New Jersey county
    12  members of the commission,
    13     One representative to be chosen by the four Pennsylvania
    14  county members of the commission,
    15     The representatives of the Cities of Philadelphia and Camden.
    16     (b)  A quorum of the executive committee for the purpose of
    17  transacting business at any committee meeting shall exist only
    18  when there are present, in person, at least [three] four members
    19  or alternates from each of the party states including at least
    20  [two of three] three of five state officials or appointees or
    21  their alternates from each state. No action of the committee
    22  shall be effective or binding unless a majority of each party
    23  state's representatives who are present at such meeting,
    24  including at least [two of the three] three of the five state's
    25  officials or appointees or their alternates, shall vote in favor
    26  thereof;

    28     Section 2.  This act shall take effect upon the enactment of
    29  legislation in the State of New Jersey providing for the
    30  appointment of legislative members from New Jersey and

     1  Pennsylvania in the same manner as provided for herein.
