           DURHAM, DAIKELER, SNYDER, SAURMAN, NAHILL, PETERSON, CIMINI,
           McCLATCHY, WILT, SIRIANNI, PICCOLA, PITTS, E. Z. TAYLOR,

        AS REPORTED FROM COMMITTEE ON RULES, HOUSE OF REPRESENTATIVES,
           AS AMENDED, MARCH 31, 1981

                          In the House of Representatives, March 9, 1981

     1     RESOLVED (the Senate concurring), That the General Assembly
     2  of the Commonwealth of Pennsylvania, pursuant to the authority
     3  and procedure provided in 42 Pa.C.S. § 2155(b), hereby rejects
     4  in their entirety the initial sentencing guidelines adopted by
     5  the Pennsylvania Commission on Sentencing as published in Volume
     6  11, Pennsylvania Bulletin, Page 463 et seq; and be it further
     7     RESOLVED, That the General Assembly urges and directs the
     8  Pennsylvania Commission on Sentencing to revise and resubmit
     9  within nine SIX months of the adoption of this resolution         <--
    10  further sentencing guidelines to the General Assembly for its
    11  consideration pursuant to 42 Pa.C.S. § 2155(b); and be it
    12  further
    13     RESOLVED, That the General Assembly submits the following
    14  suggestions to the Sentencing Commission as the areas where
    15  changes should be made in the revised sentencing guidelines: THE  <--
    16  COMMISSION SHOULD REVIEW THE INITIAL SENTENCING GUIDELINES AND

     1  EXAMINE THE ADVISABILITY OF REVISIONS:
     2         (1)  Limit such guidelines to sentencing for felonies.     <--
     3         (2) (1)  Increase the upper limit of sentences within
     4     each section of the grid.
     5         (3) (2)  Provide judges more latitude in sentencing where  <--
     6     aggravating or mitigating circumstances are found.
     7         (4) (3)  Clarify that the list of aggravating and          <--
     8     mitigating circumstances is not exclusive.
     9         (5) (4)  Eliminate prior guideline proposal relating to    <--
    10     treatment of concurrent or consecutive sentencing practices.
    11         (6) (5)  Increase the severity of sentences for crimes     <--
    12     involving serious bodily injury or the likelihood or threat
    13     of serious bodily injury.
