AN ACT
1 Amending Title 66 (Public Utilities) of the Pennsylvania
2 Consolidated Statutes, providing for insurance for
3 decontamination of nuclear power plants.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 66, act of November 25, 1970 (P.L.707,
7 No.230), known as the Pennsylvania Consolidated Statutes, is
8 amended by adding a section to read:
9 § 2108. Insurance for decontamination of nuclear power
10 plants.
11 (a) General rule.--A nuclear power plant shall not be
12 operated in this Commonwealth unless its owner or operator has
13 insurance or some other form of equivalent protection certified
14 by the commission to cover its decontamination in the event of
15 an accident involving it. The insurance coverage shall equal, in
16 the aggregate, at least $1,500,000,000, including primary
17 coverage, supplementary coverage, reasonable deductibles,
1 coinsurance and retroactive assessment agreements.
2 (b) Trust fund for assessments.--The Secretary of Revenue is
3 authorized to approve the creation of a trust fund as a
4 depository of any assessments which may be required for carrying
5 out the requirements of this section. The secretary is
6 authorized to serve as the administrator of the fund. The moneys
7 in the fund shall come exclusively from the electric utilities
8 operating nuclear power plants and shall not contain any general
9 revenue funds.
10 Section 2. This act shall take effect July 1, 1983.
