        SENATOR WILT, GAME AND FISHERIES, IN SENATE, AS AMENDED,
           NOVEMBER 15, 1982

                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1225, No.316), entitled
     2     "An act concerning game and other wild birds and wild
     3     animals; and amending, revising, consolidating, and changing
     4     the law relating thereto," further providing for the           <--
     5     operation of vehicles with flashing or rotating red lights
     6     and audible warning devices and for unlawful acts. PROVIDING   <--
     7     FOR COMMISSION RECORDS.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Sections 729.1 and 730, act of June 3, 1937        <--
    11  (P.L.1225, No.316), known as "The Game Law," amended or added
    12  June 11, 1976 (P.L.157, No.77), are amended to read:
    13     Section 729.1.  Flashing or Rotating Red Light or Lights and
    14  Audible Warning Device.--Notwithstanding any provision of any
    15  other law to the contrary, active full-time salaried
    16  Pennsylvania Game Protectors shall be authorized to operate or
    17  move any [official] vehicle [owned by the Commonwealth which is


     1  identified or marked as such by appropriate lettering, decal, or
     2  both, as approved by the commission,] upon any street or highway
     3  within the Commonwealth, with a flashing or rotating red light
     4  or lights attached to such vehicle in a temporary or permanent
     5  fashion [which is visible in any direction] and an audible
     6  warning device. Pennsylvania Deputy Game Protectors shall be
     7  authorized to operate or move any vehicle upon any street or
     8  highway within the Commonwealth, with a flashing or rotating red
     9  light or lights temporarily attached to the vehicle when
    10  performing duties within the scope of their authority. The
    11  commission shall prescribe the type of flashing or rotating red
    12  light or lights to be used and the manner of attachment to the
    13  vehicle.
    14     Section 730.  Vehicles Required to Stop Upon Signal.--It
    15  shall be unlawful for the operator of any motor vehicle to fail
    16  or refuse to stop any such vehicle or conveyance of any kind,
    17  being operated anywhere within this Commonwealth, upon request
    18  or signal of any active full-time salaried Game Protector using
    19  a flashing or rotating red light or lights or an audible warning
    20  device or Deputy Game Protector using a flashing or rotating red
    21  light or lights as defined in section 729.1 of this act, or upon
    22  request or hand signal of any officer whose duty it is to
    23  enforce the game laws, when such officer in every instance is in
    24  uniform and shall display his badge or other insignia of
    25  identification, for the purpose of inspecting or searching said
    26  vehicle or conveyance, its passengers or contents, for the
    27  unlawful possession, concealment, or transportation of any wild
    28  bird or wild animal or parts thereof, or for the purpose of
    29  inspecting or searching said vehicle or conveyance, its
    30  passengers or contents, for any other violation of the act, or

     1  to in any manner interfere with any such officer while making
     2  such inspection.
     3     It is unlawful for any person to turn off any or all lights
     4  on a vehicle or conveyance, being operated anywhere within this
     5  Commonwealth, for the purpose of avoiding identification or
     6  arrest, upon request or signal to stop as required in this
     7  section.
     8     Section 2.  Subsection (c) of section 4571 of Title 75, act
     9  of November 25, 1970 (P.L.707, No.230), known as the
    10  Pennsylvania Consolidated Statutes, is repealed.
    11     SECTION 1.  THE ACT OF JUNE 3, 1937 (P.L.1225, NO.316), KNOWN  <--
    12  AS "THE GAME LAW," IS AMENDED BY ADDING A SECTION TO READ:
    13     SECTION 309.2.  COMMISSION RECORDS.--ANY RECORDS MAINTAINED
    14  BY THE COMMISSION OR ANY ISSUING AGENT OR OTHER AGENT OF THE
    15  COMMISSION THAT CONTAIN OR INCLUDE THE HOME ADDRESS OF ANY
    16  INDIVIDUALS OR ANY OTHER PERSONAL INFORMATION ABOUT INDIVIDUALS
    17  SUCH AS HEIGHT, WEIGHT, COLOR OF HAIR AND COLOR OF EYES,
    18  INCLUDING, BUT NOT LIMITED TO HUNTING LICENSES AND APPLICATIONS
    19  THEREFOR, "GAME NEWS" SUBSCRIBER LISTS, AND PERMITS AND
    20  APPLICATIONS THEREFOR, ARE NOT PUBLIC RECORDS AS DEFINED IN
    21  SECTION 1 OF THE ACT OF JUNE 21, 1957 (P.L.390, NO.212),
    22  REFERRED TO AS THE RIGHT-TO-KNOW LAW.
    23     SECTION 2.  SECTION 1 OF THIS ACT SHALL BE RETROACTIVE TO
    24  JULY 1, 1982.
    25     Section 3.  This act shall take effect immediately.
