        AS AMENDED ON SECOND CONSIDERATION, IN SENATE, JUNE 2, 1982

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for the powers and   <--
     6     duties of executive directors of intermediate units.
     7     APPOINTMENT OF DIRECTORS TO AN INTERMEDIATE UNIT BOARD OF      <--
     8     DIRECTORS.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Section 915-A 910-A, act of March 10, 1949         <--
    12  (P.L.30, No.14), known as the "Public School Code of 1949,"
    13  added May 4, 1970 (P.L.311, No.102), is amended to read: IS       <--
    14  AMENDED BY ADDING A SUBSECTION TO READ:
    15     Section 915-A.  Powers and Duties of Executive Director.--(a)  <--
    16  The executive director of an intermediate unit shall have the
    17  power and his duty shall be:
    18     (1)  To administer the intermediate unit program of services.
    19     (2)  To appoint professional staff subject to the approval of
    20  the intermediate unit board of directors.

     1     (3)  To employ nonprofessional staff in accordance with
     2  employment policies of the intermediate unit board of directors.
     3     (4)  To prepare the budget for adoption by the intermediate
     4  unit board of directors.
     5     (5)  To direct expenditures of funds within the budget or
     6  other authorizations of the intermediate unit board of
     7  directors.
     8     (6)  To appoint such advisory groups as will assist the staff
     9  in providing programs of services for school districts.
    10     (7)  To provide the Superintendent of Public Instruction with
    11  information, reports and services.
    12     (8)  To perform such other duties as may be required by the
    13  intermediate unit board of directors and the regulations of the
    14  State Board of Education.
    15     (b)  No executive director of an intermediate unit shall be
    16  authorized or empowered to reject the appointment or election of
    17  a school director from a member school district to the
    18  intermediate unit board of directors.
    19     SECTION 910-A.  INTERMEDIATE UNIT BOARD OF DIRECTORS.--* * *   <--
    20     (H)  THE ELECTION OR APPOINTMENT OF ANY DIRECTOR FROM A
    21  MEMBER DISTRICT TO AN INTERMEDIATE UNIT BOARD OF DIRECTORS SHALL
    22  BE APPROVED BY A MAJORITY VOTE OF THE BOARD OF DIRECTORS OF THAT
    23  MEMBER DISTRICT AND A RECORD OF SUCH VOTE SHALL BECOME PART OF
    24  THE MINUTES OF SAID DISTRICT WHICH RECORD OF THE VOTE SHALL BE
    25  TRANSMITTED TO THE INTERMEDIATE UNIT, WHEREUPON THE INTERMEDIATE
    26  UNIT SHALL SEAT SUCH DIRECTOR AS A MEMBER OF THE INTERMEDIATE
    27  UNIT BOARD OF DIRECTORS.
    28     Section 2.  This act shall take effect in 60 days.
