                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for abandoned vehicles on limited
     3     access highways.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3712 of Title 75, act of November 25,
     7  1970 (P.L.707, No.230), known as the Pennsylvania Consolidated
     8  Statutes, is amended to read:
     9  § 3712.  Abandonment and stripping of vehicles.
    10     (a)  Abandonment on highway.--No person shall abandon a
    11  vehicle upon any highway. Any person abandoning a vehicle on a
    12  limited access highway shall, within 12 hours, notify the law
    13  enforcement authorities having jurisdiction of such abandonment
    14  and shall, within the next 12 hours, have the abandoned vehicle
    15  removed from the highway.
    16     (b)  Abandonment on public or private property.--No person
    17  shall abandon a vehicle upon any public or private property
    18  without the express or implied consent of the owner or person in

     1  lawful possession or control of the property.
     2     (c)  Stripping abandoned vehicle.--It is unlawful for any
     3  person, except the owner or his agent or as otherwise provided
     4  in this title, to remove any part of an abandoned vehicle.
     5     (d)  Penalties.--
     6         (1)  Any person violating subsection (a) or (b) is guilty
     7     of a summary offense and shall, upon conviction, be sentenced
     8     to pay a fine of $50 plus all costs of disposing of the
     9     vehicle under the provisions of Chapter 73 (relating to
    10     abandoned vehicles and cargos).
    11         (2)  Any person violating subsection (c):
    12             (i)  For a first offense, is guilty of a summary
    13         offense punishable by a fine of not less than $100 nor
    14         more than $500.
    15             (ii)  For a subsequent offense, is guilty of a
    16         misdemeanor of the third degree.
    17     Section 2.  This act shall take effect in 60 days.
