                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for disciplinary
     6     procedures and transfer of students in certain cases.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    10  as the "Public School Code of 1949," is amended by adding
    11  sections to read:
    12     Section 1338.1.  Transfer of Certain Students.--(a)  In the
    13  case of a student attack on a teacher, the offending student
    14  shall be transferred to another school in the same district, if
    15  available. Any cost of transportation of the student shall be
    16  paid by the parents or guardian of the offending student.
    17     (b)  If the board of school directors and the superintendent
    18  of a school district determine that the parents or guardian of
    19  the offending student are not able to pay the transportation


     1  cost provided for in subsection (a), the costs shall be borne by
     2  the school district.
     3     (c)  This section shall not apply to exceptional children.
     4     Section 1338.2.  In-School Suspension.--(a)  All school
     5  districts shall maintain an in-school suspension program. This
     6  program shall provide for suspended students to stay in one
     7  classroom all day and have no movement from class to class.
     8  Those students shall lose all privileges such as intramural
     9  activities, outside lunch, athletics and all other
    10  extracurricular activities. The purpose of this program is to
    11  allow the student to remain in school and to maintain a program
    12  of studies while under suspension. This suspension program shall
    13  not be used for minor infractions. Any costs incurred by this
    14  program shall be paid for by the parents or guardian of the
    15  offending student.
    16     (b)  If the board of school directors and the superintendent
    17  of a school district determine that the parents or guardian of
    18  the offending student are unable to pay for the costs of this
    19  suspension program as provided for in subsection (a), the costs
    20  shall be borne by the school district.
    21     (c)  This section shall not apply to exceptional children.
    22     Section 2.  This act shall take effect in 60 days.
