AN ACT
1 Amending the act of November 24, 1976 (P.L.1182, No.262),
2 entitled "An act relating to the dispensing and sale of
3 hearing aids, providing for the registration and regulation
4 of hearing aid fitters and dealers, making certain acts
5 illegal, prescribing penalties and making an appropriation,"
6 prohibiting the inclusion of material, not available in
7 standardized texts, as a testing device in examinations.
8 The General Assembly of the Commonwealth of Pennsylvania
9 hereby enacts as follows:
10 Section 1. Section 202, act of November 24, 1976 (P.L.1182,
11 No.262), known as the "Hearing Aid Sales Registration Law," is
12 amended to read:
13 Section 202. Examinations.--The department shall prepare,
14 approve, grade and conduct examinations of applicants for a
15 hearing aid fitter's certificate of registration. The department
16 may provide that the preparation and grading of the examination
17 be conducted by a competent person or organization other than
18 the department: Provided, however, That the department shall
19 establish the guidelines for the examination, and shall approve
20 the actual examination. An actual examination shall not contain
1 material or questions that are not available in standardized
2 texts on the subject matter covered by that examination.
3 Section 2. This act shall take effect in 60 days.
