        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           OCTOBER 6, 1981

                                     AN ACT

     1  Amending the act of July 28, 1953 (P.L.723, No.230), entitled,
     2     as amended, "An act relating to counties of the second class
     3     and second class A; amending, revising, consolidating and
     4     changing the laws relating thereto," further regulating
     5     contracts and purchases.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Subsection (a) AND THE INTRODUCTORY PARAGRAPH OF   <--
     9  SUBSECTION (D) of section 2001, act of July 28, 1953 (P.L.723,
    10  No.230), known as the "Second Class County Code," amended
    11  November 26, 1978 (P.L.1268, No.302), is ARE amended to read:     <--
    12     Section 2001.  County Commissioners to Make Contracts.--The
    13  County Commissioners may make contracts for lawful purposes and
    14  for the purposes of carrying into execution the provisions of
    15  this section and the laws of the Commonwealth.
    16     (a)  All contracts or purchases in excess of [two thousand
    17  five hundred dollars ($2,500)] five thousand dollars ($5,000)     <--
    18  FOUR THOUSAND DOLLARS ($4,000) shall be in writing and, except    <--


     1  those hereinafter mentioned, shall not be made except with and
     2  from the lowest responsible bidder meeting specifications, after
     3  due notice in at least one newspaper of general circulation,
     4  published or circulating in the county at least three (3) times,
     5  at intervals of not less than three (3) days where daily
     6  newspapers of general circulation are employed for such
     7  publication, or in case weekly newspapers are employed, then the
     8  notice shall be published once a week for two (2) successive
     9  weeks. The first advertisement shall be published not less than
    10  ten (10) days prior to the date fixed for the opening of bids.

    12     (D)  THE CONTRACTS OR PURCHASES MADE BY THE COMMISSIONERS      <--
    13  INVOLVING AN EXPENDITURE OF OVER [TWO THOUSAND FIVE HUNDRED
    14  DOLLARS ($2,500)] FOUR THOUSAND DOLLARS ($4,000) WHICH SHALL NOT
    15  REQUIRE ADVERTISING OR BIDDING AS HEREINBEFORE PROVIDED ARE AS
    16  FOLLOWS:

    18     SECTION 2.  SECTION 2517 OF THE ACT IS AMENDED TO READ:
    19     SECTION 2517.  SEPARATE SPECIFICATIONS AND CONTRACTS FOR
    20  CERTAIN ITEMS.--IN THE PREPARATION OF SPECIFICATIONS FOR THE
    21  ERECTION, CONSTRUCTION AND ALTERATION OF ANY PUBLIC BUILDING,
    22  WHEN THE ENTIRE COST OF SUCH WORK SHALL EXCEED [ONE THOUSAND
    23  DOLLARS ($1000)] FOUR THOUSAND DOLLARS ($4,000), THE ARCHITECT,
    24  ENGINEER OR OTHER PERSON PREPARING SUCH SPECIFICATIONS SHALL
    25  PREPARE SEPARATE SPECIFICATIONS FOR THE PLUMBING, HEATING,
    26  VENTILATING AND ELECTRICAL WORK. THE BOARD OF COMMISSIONERS
    27  SHALL RECEIVE SEPARATE BIDS UPON EACH OF THE SAID BRANCHES OF
    28  WORK AND AWARD THE CONTRACT FOR THE SAME TO THE LOWEST
    29  RESPONSIBLE BIDDER FOR EACH OF SAID BRANCHES.
    30     Section 2 3.  This act shall take effect in 60 days.           <--
