AN ACT
1 Disqualifying certain persons from holding an elective office
2 longer than the withdrawal date upon the filing of a
3 nominating petition for another office.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Whenever, during his first term, any person holds
7 a position in a political subdivision or the State to which he
8 was elected (other than an elected official of an election
9 district or political party) he shall be automatically
10 disqualified to continue to serve in that capacity if he files a
11 nominating petition for another position and he is serving in
12 other than the last year of his term of office; he shall resign
13 or be so disqualified from such office not later than the last
14 day for withdrawal of his name for nomination. A vacancy in the
15 office shall be deemed to occur upon the filing of the
16 nominating petition.
17 Section 2. This act shall take effect in 60 days.
