AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, further providing for provisions prohibiting the
3 transfer of registration to evade certain financial
4 responsibility requirements, further providing for suspension
5 for nonpayment of judgments and further providing for
6 financial responsibility.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Sections 1704(a), 1742(a), 1746 and 1747(a) of
10 Title 75, act of November 25, 1970 (P.L.707, No.230), known as
11 the Pennsylvania Consolidated Statutes, are amended to read:
12 § 1704. Transfer of suspended registration to evade chapter.
13 (a) General rule.--If the registrations of any vehicles are
14 suspended under this chapter, the registrations shall not be
15 transferred, nor the vehicles registered in [any other name,]
16 the name of the registrant's spouse, parent or child, until the
17 department is satisfied that the transfer of registrations is
18 proposed in good faith and not for the purpose or with the
19 effect of defeating the purposes of this chapter.

Suspension for nonpayment of judgments. 3 (a) General rule.--The department, upon receipt of a 4 certified copy of a judgment, shall suspend the operating 5 privilege [of each driver] and registration of each [owner] 6 person against whom the judgment was rendered except as 7 otherwise provided in this section and in section 1745 (relating 8 to installment payment of judgments). 9 * * * 10 § 1746. Proof of financial responsibility after suspension or 11 revocation. 12 Whenever the department suspends or revokes the operating 13 privilege of any person [upon receiving record of a conviction 14 or forfeiture of bail] pursuant to sections 1532(a) or (b) 15 (relating to revocation or suspension of operating privilege), 16 1542 (relating to revocation of habitual offender's license) or 17 1742 (relating to suspension for nonpayment of judgments), the 18 department shall not restore the operating privilege until the 19 person furnishes proof of financial responsibility. 20 § 1747. Providing financial responsibility. 21 (a) General rule.--Proof of financial responsibility may be 22 furnished by filing evidence satisfactory to the department that 23 all motor vehicles registered in a person's name are covered by 24 the insurance required in section 104 of the act of July 19, 25 1974 (P.L.489, No.176), known as the "Pennsylvania No-fault 26 Motor Vehicle Insurance Act," or[, if the person has no motor 27 vehicle, that the person is covered by a nonowner's policy 28 having the same limits of liability as are required in section 29 104 of that act] that a person does not own a motor vehicle. 30 * * * 19810H0230B0231 - 2 -
