AN ACT
1 Authorizing the Township of Harborcreek, Erie County, to utilize
2 a portion of land acquired pursuant to the provisions of the
3 "Project 70 Land Acquisition and Borrowing Act" for other
4 than the prescribed recreation, conservation and historical
5 purposes.
6 The General Assembly of the Commonwealth of Pennsylvania
7 hereby enacts as follows:
8 Section 1. The Township of Harborcreek, Erie County, is
9 authorized, subject to the acquisition by it of replacement
10 land, to use 7.12 acres of the land acquired by it pursuant to
11 the provisions of the act of June 22, 1964 (Sp.Sess., P.L.131,
12 No.8), known as the "Project 70 Land Acquisition and Borrowing
13 Act," included in the following descriptions for general
14 municipal purposes.
15 Parcel "A" (North of Buffalo Road)
16 Beginning at a concrete monument, the northeast corner of the
17 property. Thence south 37 degrees 03 minutes 52 seconds east
18 43.42 feet to a concrete monument on the north right-of-way of
19 Buffalo Road, an 80 foot row; thence south 62 degrees 40 minutes
1 12 seconds west along said right-of-way 498.37 feet to a
2 concrete monument; thence north 37 degrees 03 minutes 45 seconds
3 west 43.48 feet to a concrete monument; thence north 62 degrees
4 40 minutes 12 seconds east 498.37 feet to the place of
5 beginning. Containing .49 acre.
6 Parcel "B" (South of Buffalo Road)
7 Beginning at a concrete monument at the northwest corner of
8 the property said point being on the south right-of-way line of
9 Buffalo Road an 80 foot right-of-way. Thence north 62 degrees 40
10 minutes 12 seconds east along the southern right-of-way of
11 Buffalo Road 498.37 feet to a concrete monument; thence south 37
12 degrees 03 minutes 52 seconds east 1470.01 feet to a concrete
13 monument passing over a concrete monument at 1222.24 feet;
14 thence south 62 degrees 40 minutes 12 seconds west 498.42 feet
15 to a concrete monument; thence north 37 degrees 03 minutes 45
16 seconds west 1470.00 feet to the place of beginning. Containing
17 16.58 acres.
18 Section 2. The Township of Harborcreek, Erie County, shall,
19 for the release of the use restrictions imposed by the "Project
20 70 Land Acquisition and Borrowing Act" on the 7.12 acres
21 described in section 1, acquire replacement land acceptable to
22 the Department of Community Affairs. The deed of transfer for
23 the replacement land shall recite that it was acquired for
24 recreation, conservation and historical purposes in accordance
25 with provisions of the aforesaid act.
26 Section 3. This act shall take effect in 60 days.
