A SUPPLEMENT 1 To the act of April 1, 1863 (P.L.213, No.227), entitled "An act 2 to accept the grant of Public Lands, by the United States, to 3 the several states, for the endowment of Agricultural 4 Colleges," making appropriations for carrying the same into 5 effect, providing for a basis for payments of such 6 appropriations and providing a method of accounting for the 7 funds appropriated. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. In order to carry into effect the act of 11 Congress, approved July 2, 1862, granting public land to the 12 several states for educational purposes, and subsequent acts of 13 Congress related thereto, and the act of the General Assembly of 14 Pennsylvania accepting the provisions and conditions of said 15 acts of Congress and pledging the faith of the State to carry 16 the same into effect, the following sums or as much thereof as 17 may be necessary are hereby specifically appropriated to the 18 Trustees of the Pennsylvania State University for the fiscal 19 year July 1, 1980 to June 30, 1981, for the purposes and in the 20 amounts as shown:
1 (1) For educational and general expenses..... $94,704,000 2 (2) For cost of student aid.................. 1,760,000 3 (3) For cost of agricultural research........ 10,266,000 4 (4) For cost of agricultural extension 5 services................................. 8,688,000 6 (5) For cost of research..................... 8,626,000 7 (6) For instruction - Doctor of Medicine 8 only..................................... 2,896,000 9 (7) For cost of soil survey.................. 100,000 10 Section 2. Payments to Pennsylvania State University on 11 account of the appropriations for all items as provided in 12 section 1 except for instruction - Doctor of Medicine shall be 13 made on the basis of costs during the fiscal year. 14 Payments for instruction - Doctor of Medicine shall be made 15 on the basis of full-time students enrollment at a rate not to 16 exceed $7,465 per student. 17 Section 3. If necessary, the Pennsylvania State University 18 may transfer funds among the appropriations listed in section 1, 19 clauses (1), (2), (3) (4) and (5): Provided, That the aggregate 20 amount transferred into or out of each appropriation during the 21 fiscal year shall not exceed 5% of the amount specifically 22 appropriated for that purpose. 23 Section 4. Payments to the Pennsylvania State University of 24 the appropriations herein provided shall be made monthly during 25 the fiscal year. 26 Such monthly payments shall be made in accordance with the 27 provisions of sections 2 and 3, on the basis of estimated costs 28 and full-time students enrolled in the Doctor of Medicine 29 program. The estimate of costs shall be submitted by the 30 Pennsylvania State University to the Secretary of Education, the 19800S1535B2044 - 2 -
1 General Assembly and to the State Treasurer not later than 30 2 days prior to the date on which such payment is to be made. 3 Section 5. Notwithstanding any provision of the General 4 Appropriation Act of 1980 relating to the payment of retirement 5 expenses, the Trustees of the Pennsylvania State University 6 shall make all required payments to the State Employees' 7 Retirement Fund from the funds appropriated pursuant to this 8 act. 9 Section 6. The Pennsylvania State University shall apply the 10 moneys appropriated by this act only for such purposes as are 11 permitted in this act and shall at all times maintain proper 12 records showing the application of such moneys. Not later than 13 120 days after the close of the fiscal year to which this act 14 relates, the Pennsylvania State University shall file with the 15 Secretary of Education, the General Assembly, and with the 16 Auditor General of the Commonwealth, a statement setting forth 17 the amounts and purposes of all expenditures made from moneys 18 appropriated by this act and other university accounts during 19 said fiscal year, the number of full-time students enrolled in 20 the Doctor of Medicine program and costs, as provided in 21 sections 2 and 3, used as a basis for receipt of any 22 appropriation during said fiscal year. 23 Such statement of expenditures and number of full-time 24 students enrolled in the Doctor of Medicine program and costs 25 shall be reviewed by the Auditor General of the Commonwealth, 26 and he shall have the right, in respect to the moneys 27 appropriated by this act, to audit and disallow expenditures 28 made for purposes not permitted by this act and to cause such 29 sums to be recovered and paid by the Pennsylvania State 30 University to the Treasurer of the Commonwealth. 1 General shall also make a determination of full-time students 2 enrolled in the Doctor of Medicine program and costs and make a 3 certification as to their correctness. In respect to 4 expenditures made by the university from moneys other than those 5 appropriated by this act, the Auditor General shall have the 6 right to review only and he shall file annually with the General 7 Assembly such information concerning such expenditures as the 8 General Assembly or any of its committees may require. 9 Section 7. A report shall be submitted to the Governor and 10 the Appropriations and Education Committees of the Senate and 11 House of Representatives and shall include data for all programs 12 except the Doctor of Medicine program. Each such report, to be 13 submitted prior to October 1, 1981, shall cover the 12-month 14 period beginning September 1, 1980 and shall include for each 15 term during the period: 16 (1) The following counts and distributions: 17 (i) The definitions and numbers of faculty members employed 18 full-time, of faculty members employed part-time, of full-time 19 students enrolled in graduate courses, of full-time students 20 enrolled in undergraduate courses, of part-time students 21 enrolled in graduate courses, and of part-time students enrolled 22 in undergraduate courses. 23 (ii) A distribution of faculty members employed part-time by 24 the percentage of full-time employment. 25 (iii) Total numbers of undergraduate student credit hours, 26 divided into lower division and upper division course levels, 27 and of graduate student credit hours divided into three course 28 levels--master's, first professional and doctoral. 29 (iv) Number of different courses scheduled by level of 30 instruction and the number of students receiving individual 19800S1535B2044 - 4 -
1 instruction at each level of instruction. 2 (v) Number of terms scheduled and the dates thereof. 3 (2) Two classifications: one, a classification of faculty 4 members or other professional employees by title including: 5 professor, associate professor, assistant professor, instructor, 6 lecturer, research associate, librarian and academic 7 administrator; faculty members or other professional employees 8 under each title to be subdivided by type of assignment: 9 instructional or noninstructional divided into teaching and 10 nonteaching, and each such set of faculty members or other 11 professional employees to be further subdivided by type of 12 employment: full-time or part-time; and two, a classification of 13 faculty members and other professional employees by school and 14 department to be subdivided by type of assignment: instructional 15 or noninstructional divided into teaching and nonteaching, and 16 each such set of faculty members or other professional employees 17 to be further subdivided by type of employment: full-time or 18 part-time; and the following aggregates for each subdivision in 19 each classification: 20 (i) The number. 21 (ii) The sum of credits assigned to undergraduate classroom 22 courses and the sum of credits assigned to graduate classroom 23 courses taught, divided into lower division, upper division, 24 master's, first professional and doctoral course levels. 25 (iii) The sum of undergraduate classroom student credit 26 hours and the sum of graduate classroom student credit hours 27 generated; divided into lower division, upper division, 28 master's, first professional and doctoral course levels. 29 (iv) The sum of undergraduate individual instruction student 30 credit hours and the sum of graduate individual instruction 19800S1535B2044 - 5 -
1 student credit hours generated; divided into lower division, 2 upper division, master's, first professional and doctoral course 3 levels. 4 (v) Total salary paid. 5 (vi) Total salary paid from college or university funds. 6 (vii) Total salary paid from Federal funds. 7 (viii) Total salary paid from other funds. 8 (3) For each term of the period covered for each faculty 9 member employed full-time identified by school, department and 10 title: 11 An analysis of the average hours per week spent in college or 12 university-related activities, stating specifically hours spent 13 in undergraduate classroom contact and graduate classroom 14 contact, hours spent in preparation, hours spent in research and 15 hours spent in public service. 16 Section 8. In addition to the above requirements relative to 17 this appropriation, each report covering the 12-month period 18 beginning September 1, 1980, shall include for all programs of 19 the university: 20 (1) Minimum number of credits required for a baccalaureate 21 degree and for a master's degree. 22 (2) Number of bachelor's degrees, master's degrees, first 23 professional degrees, and doctoral degrees awarded in 1978, 24 1979, 1980 and estimated 1981. 25 The university shall report its revenues and expenditures and 26 present its financial statements required under the provisions 27 of this act in accordance with "Higher Education Finance Manual" 28 (1975). 29 Section 9. The university shall provide such information as 30 may be necessary to carry out the provisions of this act and in 19800S1535B2044 - 6 -
1 such form and manner as the Department of Education may 2 prescribe. 3 Section 10. The Pennsylvania State University shall report 4 its revenues and expenditures and present its financial 5 statements required under the provisions of this act in 6 accordance with generally accepted accounting principles and 7 procedures for educational institutions as set forth in "Higher 8 Education Finance Manual" United States Department of Health, 9 Education and Welfare (1975) with the exceptions set forth in 10 the Commonwealth of Pennsylvania Budget Instructions for State 11 Related Universities, Phase I, Fiscal Year 1980-1981. Credits 12 granted for nontraditional programs such as CLEP, lifelong 13 learning etc., including all related costs and revenues thereof 14 shall be excluded from the function of "Instruction" and 15 included under "Public Service." 16 Section 11. In addition to the requirements of section 7, 17 the Pennsylvania State University shall, by March 1, 1980, 18 submit to the Appropriations and Education Committees of the 19 Senate and the House of Representatives a breakdown of the funds 20 budgeted for this fiscal year for the main campus and each 21 branch campus including expenditures budgeted from this act and 22 expenditures budgeted from moneys other than those appropriated 23 by this act. 24 Section 12. All sums of money paid to the Trustees of the 25 Pennsylvania State University pursuant to the appropriation of 26 the act of July 11, 1980 (No.31A), entitled "A supplement to the 27 act of April 1, 1863 (P.L.213, No.227), entitled 'An act to 28 accept the grant of Public Lands, by the United States, to the 29 several states, for the endowment of Agricultural Colleges,' 30 making appropriations for carrying the same into effect, 19800S1535B2044 - 7 -
1 providing for a basis for payments of such appropriations and 2 providing a method of accounting for the funds appropriated," 3 shall be credited toward and deducted from the amount 4 appropriated in this act. 5 Section 13. The act of July 11, 1980 (No.31A), entitled "A 6 supplement to the act of April 1, 1863 (P.L.213, No.227), 7 entitled 'An act to accept the grant of Public Lands, by the 8 United States, to the several states, for the endowment of 9 Agricultural Colleges,' making appropriations for carrying the 10 same into effect, providing for a basis for payments of such 11 appropriations and providing a method of accounting for the 12 funds appropriated," is repealed. 13 Section 14.
