                                     AN ACT

     1  Amending the act of June 24, 1931 (P.L.1206, No.331), entitled
     2     "An act concerning townships of the first class; amending,
     3     revising, consolidating, and changing the law relating
     4     thereto," authorizing the establishment or designation of
     5     certain reserved areas to be used solely for parking by
     6     handicapped individuals.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Clause XLIX of section 1502, act of June 24, 1931
    10  (P.L.1206, No.331), known as "The First Class Township Code,"
    11  reenacted and amended May 27, 1949 (P.L.1955, No.569), is
    12  amended to read:
    13     Section 1502.  The corporate power of a township of the first
    14  class shall be vested in the board of township commissioners.

    17     XLIX.  Parking and Parking Lots. To regulate parking, [and]
    18  to provide parking accommodations so as to promote the
    19  convenience and protection of the public and to establish or
    20  designate, at the discretion of the commissioners, areas

     1  exclusively reserved for parking by handicapped individuals; to
     2  erect parking meters and to regulate parking meter charges and
     3  to post signs regulating parking in areas established or
     4  designated for handicapped parking. To acquire by gift or
     5  purchase, or the right of eminent domain, lands for use as
     6  parking lots, and to plan, design, locate, hold, construct,
     7  improve, maintain, operate, own or lease, either in the capacity
     8  of lessor or lessee and install facilities and equipment,
     9  including parking meters, on any such land to be devoted to the
    10  parking of vehicles of any kind, which in the judgment of the
    11  board of township commissioners, may be necessary and desirable
    12  for the purpose of establishing and maintaining such parking
    13  lots and to regulate the use thereof. Whenever any lands shall
    14  be acquired by any township for parking lots, they may be
    15  operated by such townships as parking lots for parking vehicles
    16  only, but not for the sale or distribution of any commodity, or
    17  when so provided by ordinance or resolution, they may be let to
    18  and for private operation as parking lots on such terms and
    19  conditions as may be prescribed.
