AN ACT 1 Amending the act of February 1, 1966 (1965 P.L.1656, No.581), 2 entitled, "An act concerning boroughs, and revising, amending 3 and consolidating the law relating to boroughs," authorizing 4 the establishment or designation of certain reserved areas to 5 be used solely for parking by handicapped individuals. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Clause (46) of section 1202 and section 2903, act 9 of February 1, 1966 (1965 P.L.1656, No.581), known as "The 10 Borough Code," are amended to read: 11 Section 1202. Specific Powers.--The powers of the borough 12 shall be vested in the corporate authorities. Among the specific 13 powers of the borough shall be the following, and in the 14 exercise of any of such powers involving the enactment of any 15 ordinance or the making of any regulation, restriction or 16 prohibition, the borough may provide for the enforcement thereof 17 and may prescribe penalties for the violation thereof or for the 18 failure to conform thereto: 19 * * *
1 (46) Parking lots. To acquire by lease, purchase or eminent 2 domain any land which the corporate authorities may deem 3 necessary or desirable for the purpose of establishing and 4 maintaining parking lots, and to regulate the use thereof, and 5 to regulate parking and provide parking accommodations so as to 6 promote the convenience and protection of the public and to 7 establish or designate, at the discretion of the corporate 8 authorities, areas exclusively reserved for parking by 9 handicapped individuals and to post signs regulating such areas. 10 The right to regulate the use of the lots shall include the 11 right to impose fines and fees for violation of any law or 12 ordinance regulating parking. 13 * * * 14 Section 2903. Licensing Parking Lots Operated for Profit.-- 15 Any borough may, by ordinance, regulate the business of 16 operating parking lots for profit within the borough and may 17 require such lots to reserve areas exclusively for parking by 18 handicapped individuals. License or permit fees may be charged 19 and collected from the operators of such parking lots. Any 20 borough adopting such a regulatory plan shall require from each 21 operator of such a parking lot a bond to be approved by council 22 for the protection of the public from loss of or damage to 23 vehicles parked, stored or placed under the jurisdiction of such 24 parking lot operator: Provided, That nothing in this section 25 shall apply to parking lots operated by a municipal authority or 26 a parking authority. 27 Section 2.
