                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for the inspection of vehicles.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Section 4703 of Title 75, act of November 25,
     6  1970 (P.L.707, No.230), known as the Pennsylvania Consolidated
     7  Statutes, is amended to read:
     8  § 4703.  Operation of vehicle without official certificate of
     9           inspection.
    10     (a)  General rule.--No [registered] motor vehicle required to
    11  be registered in this Commonwealth BEAR CURRENT PENNSYLVANIA      <--
    12  REGISTRATION PLATES shall be driven and no [registered] trailer
    13  required to be registered in this Commonwealth BEAR CURRENT       <--
    14  PENNSYLVANIA REGISTRATION PLATES shall be moved on a highway
    15  unless the vehicle displays a currently valid certificate of
    16  inspection [and approval].
    17     (b)  Exceptions.--Subsection (a) does not apply to:
    18         (1)  Special mobile equipment.


     1         (2)  Implements of husbandry.
     2         (3)  Motor vehicles being towed.
     3         (4)  Motor vehicles being operated or trailers being
     4     towed by an official inspection station owner or employee for
     5     the purpose of inspection.
     6         (5)  Trailers having a registered gross weight of 3,000
     7     pounds or less.
     8         (6)  Motorized pedalcycles.
     9         (7)  Vehicles being repossessed by a financer or
    10     collector-repossessor through the use of miscellaneous motor
    11     vehicle business registration plates.
    12         (8)  New vehicles while they are in the process of
    13     manufacture, including testing, and not in transit from the
    14     manufacturer to a purchaser or dealer.
    15     (c)  Inspection of vehicles reentering this Commonwealth.--
    16  Vehicles subject to inspection which have been outside this
    17  Commonwealth continuously for 30 days or more and which, at the
    18  time of reentering this Commonwealth, do not bear a currently
    19  valid certificate of inspection shall be inspected within five
    20  days of reentering this Commonwealth.
    21     (d)  Newly-purchased vehicles.--Newly-purchased vehicles may
    22  be driven without being inspected for five days after purchase
    23  or entry into this Commonwealth, whichever occurs later.
    24     [(c)] (e)  Display of unauthorized certificate of
    25  inspection.--No certificate of inspection [and approval] shall
    26  be displayed unless an official inspection has been made and the
    27  vehicle is in conformance with the provisions of this chapter.
    28     [(d)] (f)  Authority of police.--Any police officer may stop
    29  any motor vehicle or trailer and require the owner or operator
    30  to display an official certificate of inspection [and approval]

     1  for the vehicle being operated. A police officer may summarily
     2  remove an unauthorized, expired or unlawfully issued certificate
     3  of inspection from any vehicle.
     4     (g)  Limitation on prosecution.--A motor vehicle shall be the
     5  subject of only one arrest under subsection (a) in any 24-hour
     6  period.
     7     (h)  Penalty.--Any person violating this section is guilty of
     8  a summary offense and shall, upon conviction, be sentenced to
     9  pay a fine of up to $25.
    10     Section 2.  This act shall take effect in 60 days.
