        AS AMENDED ON SECOND CONSIDERATION, MAY 1, 1979

                                     AN ACT

     1  Amending the act of April 28, 1978 (P.L.122, No.51), entitled
     2     "An act providing for grants to persons for property damaged
     3     or destroyed by flood, establishing the basis for the grants,
     4     and making an appropriation," CLARIFYING AN EXCLUSION AND      <--
     5     extending the date for submitting applications for grants.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section SECTIONS 2 AND 3, act of April 28, 1978    <--
     9  (P.L.122, No.51), entitled "An act providing for grants to
    10  persons for property damaged or destroyed by flood, establishing
    11  the basis for the grants, and making an appropriation," is ARE    <--
    12  amended to read:
    13     SECTION 2.  IF REAL PROPERTY WAS CONDEMNED UNDER EMINENT       <--
    14  DOMAIN PROCEEDINGS AND WHERE MEASURE OF DAMAGE IS CALCULATED
    15  UNDER SECTION 602 OF THE ACT OF JUNE 22, 1964 (P.L.84, NO.6),
    16  KNOWN AS THE "EMINENT DOMAIN CODE," SAID OWNER SHALL NOT BE
    17  ELIGIBLE FOR [THE] A grant provided in section 1 FOR ANY          <--
    18  PROPERTY FOR WHICH COMPENSATION IS GRANTED IN THE EMINENT DOMAIN
    19  PROCEEDINGS.


     1     Section 3.  All grants under this act shall be administered
     2  by the Department of Public Welfare [and all applications for
     3  grants shall be submitted to that department within 120 days
     4  after the effective date of this act]. If sufficient funds are
     5  not allocated herein, distribution of grants shall be on a pro
     6  rata basis.
     7     Section 2.  All applications for grants shall be submitted to
     8  the Department of Public Welfare within 60 days after the
     9  effective date of this amendatory act.
    10     Section 3.  This act shall take effect immediately.
