           REPRESENTATIVES, AS AMENDED, OCTOBER 2, 1979

                                     AN ACT

     1  Amending the act of May 13, 1915 (P.L.286, No.177), entitled, as
     2     amended, "An act to provide for the health, safety, and
     3     welfare of minors; By forbidding their employment or work in
     4     certain establishments and occupations, and under certain
     5     specified ages; by restricting their hours of labor, and
     6     regulating certain conditions of their employment; by
     7     requiring employment certificates for certain minors, and
     8     prescribing the kinds thereof, and the rules for the
     9     issuance, reissuance, filing, return, and recording of the
    10     same; by providing that the Industrial Board shall, under
    11     certain conditions, determine and declare whether certain
    12     occupations are within the prohibitions of this act;
    13     requiring certain abstracts and notices to be posted;
    14     providing for the enforcement of this act by the Secretary of
    15     Labor and Industry, the representative of school districts,
    16     and police officers; and defining the procedure in
    17     prosecutions thereunder, and establishing certain
    18     presumptions in relation thereto; providing for the issuance
    19     of special permits for minors engaging in the entertainment
    20     and related fields; providing penalties for the violation of
    21     the provisions thereof; and repealing all acts or parts of
    22     acts inconsistent therewith," authorizing certified nurse
    23     practitioners to administer certain physicals.

    24     The General Assembly of the Commonwealth of Pennsylvania
    25  hereby enacts as follows:
    26     Section 1.  Section 14, act of May 13, 1915 (P.L.286,
    27  No.177), known as the "Child Labor Law," amended January 26,
    28  1966 (1965 P.L.1590, No.559), is amended to read:

     1     Section 14.  The certificate of physical fitness required by
     2  this act shall state that the minor has been thoroughly examined
     3  by the said examining physician or certified nurse practitioner,  <--
     4  CERTIFIED NURSE PRACTITIONER, OR CERTIFIED REGISTERED NURSE
     5  PRACTITIONER at the time of the application for an employment
     6  certificate, and is physically qualified for the employment
     7  specified in the statement of the prospective employer. In any
     8  case where the said physician or certified nurse practitioner,    <--
     9  CERTIFIED NURSE PRACTITIONER, OR CERTIFIED REGISTERED NURSE
    10  PRACTITIONER shall deem it advisable, he may issue a certificate
    11  of physical fitness for a limited time; at the expiration of
    12  which time the holder shall again appear, and submit to a new
    13  examination before being permitted to continue at work. Except
    14  as hereinafter provided, in a school district of the first,
    15  second, or third class the physical examination of a minor
    16  provided for by this act shall be made by a physician or          <--
    17  certified nurse practitioner, CERTIFIED NURSE PRACTITIONER, OR    <--
    18  CERTIFIED REGISTERED NURSE PRACTITIONER employed by the board of
    19  school directors of the school district in which such minor
    20  resides, and in a district of the fourth class by a physician or  <--
    21  certified nurse practitioner, CERTIFIED NURSE PRACTITIONER, OR    <--
    22  CERTIFIED REGISTERED NURSE PRACTITIONER appointed by the State
    23  Department of Health and the certificate of physical fitness
    24  provided for by this act shall be signed by said physician or     <--
    25  certified nurse practitioner, CERTIFIED NURSE PRACTITIONER, OR    <--
    26  CERTIFIED REGISTERED NURSE PRACTITIONER, and no fee or other
    27  compensation for such service shall be required to be paid by
    28  such minor or by his parent or guardian: Provided, however, That
    29  any minor may, at his own expense, have the physical examination
    30  provided for by this act made and the certificate of physical

     1  fitness signed by his family physician, as defined in section
     2  1401 of the Public School Code of 1949, and its amendments. Any
     3  physical examination required by this act to be accomplished as
     4  a condition of employment which would be equal to or more
     5  comprehensive than the standard examination given by the school
     6  physician, or certified nurse practitioner, CERTIFIED NURSE       <--
     7  PRACTITIONER, OR CERTIFIED REGISTERED NURSE PRACTITIONER or
     8  family physician will be deemed to meet the requirements of this
     9  section, and the certificate of physical fitness may be signed
    10  by the physician designated by the prospective employer to
    11  perform such examination. For the purposes of this section,
    12  "certified nurse practitioner" shall mean a certified school
    13  nurse who is a graduate of a nurse practitioner program which
    14  has been approved by the Department of Health School Nurse
    15  Advisory Committee, OR A CERTIFIED REGISTERED NURSE PRACTITIONER  <--
    16  WHO HAS BEEN APPROVED BY THE STATE BOARD OF NURSE EXAMINERS OF
    17  THE DEPARTMENT OF STATE.
    18     Section 2.  This act shall take effect in 60 days.
