                                     AN ACT

     1  Authorizing the Department of Transportation with the approval
     2     of the Governor and the Department of Justice to acquire
     3     title to a certain parcel of land in Millstone Township, Elk
     4     County.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  The Department of Transportation, with the
     8  approval of the Governor and the Department of Justice is hereby
     9  authorized to acquire fee simple title to the following real
    10  property located in Millstone Township, Elk County, more
    11  particularly bounded and described as follows:
    12     Beginning at a point on the southern legal right-of-way line
    13  of Legislative Route 24002 and the northern property line of
    14  Kenneth Cargo said point being 25 feet measured from the center
    15  of L.R. 24002; thence along said property line north 83 degrees
    16  00 minutes 30 seconds east 626.86 feet to a point on the
    17  westerly line of Bob R. and L. Joan George; thence along the
    18  said westerly line north 24 degrees 30 minutes east 686.15 feet
    19  to a point on the southern legal right-of-way line of L.R. 24002


     1  said point being 25 feet measured from the center of said road;
     2  thence southerly along said right-of-way line south 46 degrees
     3  30 minutes 20 seconds west 717.73 feet to a point; thence
     4  continuing along said right-of-way by a curve to the right with
     5  a radius of 844.02 feet a distance of 442.91 feet to a point and
     6  place of beginning. Containing 3.079 acres.
     7     The above described parcel being a portion of land conveyed
     8  by John W. Thacher and Freeda L. Thacher to William H. Thacher
     9  and Gail L. Thacher by deed May 11, 1966 and recorded in the Elk
    10  County Courthouse in Deed Book 168 Page 767.
    11     Section 2.  The consideration for the conveyance herein
    12  authorized shall be determined by an independent appraisal
    13  conducted in a manner agreeable to both parties.
    14     Section 3.  This conveyance is hereby authorized
    15  notwithstanding any provision of law prohibiting such a
    16  conveyance between a Commonwealth agency and a Commonwealth
    17  employee.
    18     Section 4.  This act shall take effect immediately.
