In the House of Representatives, October 31, 1979 1 WHEREAS, Representative Matthew J. Cianciulli was tried and 2 convicted by the court and a jury in the United States District 3 Court for the Eastern District of Pennsylvania for violations of 4 Title 42, United States Code, § 1973(i) and Title 18, United 5 States Code, §§ 2 and 241; and 6 WHEREAS, Sentence pursuant to a finding of guilty was imposed 7 by court on October 25, 1979; and 8 WHEREAS, Representative Matthew J. Cianciulli has appealed 9 said conviction and sentence to the United States Circuit Court 10 of Appeals; and 11 WHEREAS, Pursuant to Article II, section 11 of the 12 Constitution of Pennsylvania, the House of Representatives has 13 the power to determine the rules of its proceedings, to punish 14 its members and has all other powers necessary for the 15 Legislature of a free state, including, inter alia, the 16 protection of the integrity of the House against alleged 17 corruption or misconduct by its members; therefore be it
1 RESOLVED, That pursuant to such powers vested in the House of 2 Representatives under Article II, section 11 of the Constitution 3 of the Commonwealth, the House of Representatives hereby 4 immediately suspends the rights and privileges of Matthew J. 5 Cianciulli, until such time as the United States Circuit Court 6 of Appeals, or the United States Supreme Court, as the case may 7 be, shall hear and finally determine such appeal, or until the 8 term of such member is constitutionally terminated on November 9 30, 1980, whichever shall first occur; and be it further 10 RESOLVED, That such suspension of rights and privileges shall 11 include, but not be limited to: a forfeiture of all seating, 12 speaking or voting privileges as a member on the floor of the 13 House of Representatives; serving as a member of any standing 14 committee or other committees of the House; a denial by the 15 House of all compensation or expense reimbursement; legislative 16 office space in Harrisburg or elsewhere, secretarial or 17 legislative staff assistance, all fringe benefits of any nature; 18 and all other rights, duties, privileges or benefits normally 19 granted to other members of the House of Representatives.
