                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1225, No.316), entitled
     2     "An act concerning game and other wild birds and wild
     3     animals; and amending, revising, consolidating, and changing
     4     the law relating thereto," prohibiting the revocation of
     5     appointment as a deputy game protector solely for reason of
     6     age.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 208, act of June 3, 1937 (P.L.1225,
    10  No.316), known as the "Game Law," amended February 15, 1980
    11  (No.7), is amended to read:
    12     Section 208.  Deputy Game Protectors.--(a)  The commission
    13  may appoint competent men throughout the Commonwealth, to be
    14  known as deputy game protectors, in such numbers as the
    15  commission may deem necessary, who shall possess the rights and
    16  powers given by law to game protectors, and be subject to all
    17  requirements and regulations, either of the law or of rules of
    18  the commission, controlling the action of such game protectors.
    19     (b)  Such deputy game protectors shall not be entitled to


     1  recompense for either time or expenses incurred in the
     2  performance of their duties unless specifically employed for
     3  special duties by written order of the executive director, in
     4  which the rate of compensation and allowance for expenses shall
     5  be stipulated. The commission shall from time to time fix the
     6  rate of compensation for such services.
     7     (c)  Any deputy game protector while not specifically
     8  employed in writing for special duties, as above stipulated,
     9  shall be entitled to collect such fees as are now, or may
    10  hereafter be, paid to constables, to be assessed and collected
    11  as costs of prosecution, for services legally rendered in the
    12  performance of any duties in the enforcement of the several
    13  provisions of this act.
    14     (d)  The commission shall not revoke the appointment of any
    15  deputy game protector solely for reason of age unless the deputy
    16  is deemed by the chief of the respective field division to be
    17  physically unable to perform all the duties of a deputy.
    18     Section 2.  This act shall take effect immediately and shall
    19  be retroactive to January 1, 1980.
