AN ACT 1 Amending the act of June 2, 1915 (P.L.736, No.338), entitled, as 2 amended, "An act defining the liability of an employer to pay 3 damages for injuries received by an employe in the course of 4 employment; establishing an elective schedule of 5 compensation; providing procedure for the determination of 6 liability and compensation thereunder; and prescribing 7 penalties," further providing for credits against awards. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. Section 204, act of June 2, 1915 (P.L.736, 11 No.338), known as "The Pennsylvania Workmen's Compensation Act," 12 reenacted and amended June 21, 1939 (P.L.520, No.281) and 13 amended December 5, 1974 (P.L.782, No.263), is amended to read: 14 Section 204. No agreement, composition, or release of 15 damages made before the date of any injury shall be valid or 16 shall bar a claim for damages resulting therefrom; and any such 17 agreement is declared to be against the public policy of this 18 Commonwealth. The receipt of benefits from any association, 19 society, or fund shall not bar the recovery of damages by action 20 at law, nor the recovery of compensation under article three
1 hereof; and any release executed in consideration of such 2 benefits shall be void: Provided, however, That if the employe 3 receives unemployment compensation benefits, such amount or 4 amounts so received shall be credited as against the amount of 5 the award made under the provisions of section 108 or subsection 6 (a) or (b) of section 306. 7 Section 2.
