AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES, JUNE 11, 1980
AN ACT 1 Amending the act of March 28, 1974 (P.L.228, No.50), entitled 2 "An act providing for the annual announcement of grants by 3 the Pennsylvania Higher Education Assistance Agency; 4 authorizing the continuing appropriation of certain funds; 5 and providing for the manner in which certain appropriations 6 may be revised," further providing for coordination with 7 Federal financial aid programs. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. The title and sections 1, 2 and 4, act of March 11 28, 1974 (P.L.228, No.50), referred to as the Higher Education 12 Assistance Continuation Law, are amended to read: 13 AN ACT 14 Providing for the annual announcement of grants by the 15 Pennsylvania Higher Education Assistance Agency; authorizing 16 the continuing appropriation of certain funds; providing for 17 coordination with available Federal programs; and providing 18 for the manner in which certain appropriations may be 19 revised.
1 Section 1. In order to encourage needy students to make 2 timely application for enrollment in postsecondary educational 3 programs, and coordinated the State and Federal evaluation and 4 announcement of the student's eligibility to receive financial 5 aid, the Pennsylvania Higher Education Assistance Agency 6 annually, on the [first] FIFTEENTH day of [May] March, shall <-- 7 have the authority to announce the scholarships and educational 8 assistance grants to be awarded by the agency for the next 9 succeeding academic year pursuant to the provisions of the act 10 of January 25, 1966 (P.L.1546, No.541), entitled "An act 11 providing scholarships and providing funds to secure Federal 12 funds for qualified students of the Commonwealth of Pennsylvania 13 who need financial assistance to attend postsecondary 14 institutions of higher learning, making an appropriation, and 15 providing for the administration of this act," and the act of 16 October 11, 1972 (P.L.909, No.216), known as the "Veterans' 17 Education Act of 1971," and the act of October 11, 1972 18 (P.L.899, No.213), entitled "An act providing scholarships for 19 certain dependents of members of the armed services who while on 20 active duty are taken as prisoners of war or are reported 21 missing in action and making an appropriation," not to exceed 22 the amounts appropriated for the current fiscal year. 23 Section 2. In order to carry out the provisions of section 1 24 of this act, any appropriation effective during any fiscal year 25 providing moneys to the Pennsylvania Higher Education Assistance 26 Agency for scholarship grants shall, if the General Assembly 27 does not provide by law prior to [May] March 1] MARCH 15 of the <-- 28 same fiscal year, to increase, lower or terminate the 29 appropriation, be deemed to be reenacted for the ensuing fiscal 30 year in the same amount and for the same purpose as provided in 19800H2159B3505 - 2 -
1 such appropriation: Provided, however, That the reenacted 2 appropriation shall not be effective until the first day of the 3 ensuing fiscal year. 4 Section 4. If the General Assembly at any time hereafter 5 shall enact legislation to reduce appropriations for scholarship 6 grants prior to the [first] FIFTEENTH day of [May] March such <-- 7 enactment shall be applicable to the next succeeding academic 8 year. Should such enactment be made after the [first] FIFTEENTH <-- 9 of [May] March, the provisions thereof shall be applicable to 10 the academic year following the next succeeding academic year. 11 Section 2.
