        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           NOVEMBER 17, 1980

                                     AN ACT

     1  Amending the act of July 20, 1979 (No.51), entitled "An act
     2     establishing a uniform mileage fee for all officials,
     3     officers and employees of the Commonwealth, its political
     4     subdivisions, intermediate units, and authorities,"
     5     permitting mileage to be fixed by collective bargaining
     6     agreements or arbitration awards.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 1, act of July 20, 1979 (No.51), entitled
    10  "An act establishing a uniform mileage fee for all officials,
    11  officers and employees of the Commonwealth, its political
    12  subdivisions, intermediate units, and authorities," is amended
    13  to read:
    14     Section 1.  Notwithstanding the provisions of any other act
    15  to the contrary the mileage fee to be charged and received by
    16  any official, officer or employee of the Commonwealth, its
    17  departments, bureaus, boards, commissions, agencies and
    18  authorities and any official, officer or employee of its
    19  political subdivisions or authorities created thereby, or of an

     1  intermediate unit shall be [17¢] 20¢ OR THE STANDARD MILEAGE      <--
     2  RATE ALLOWED AS A BUSINESS DEDUCTION BY THE INTERNAL REVENUE
     3  SERVICE per mile, IF IT IS HIGHER unless [a lesser rate is        <--
     4  adopted by the department, bureau, board, commission, agency,
     5  authority, political subdivision or intermediate unit] a
     6  collective bargaining agreement or arbitration award between a
     7  public employer and a union certified as an exclusive
     8  representative pursuant to provisions of the act of July 23,
     9  1970 (P.L.563, No.195), known as the "Public Employe Relations
    10  Act," or the act of June 24, 1968 (P.L.237, No.111), referred to
    11  as the Policemen and Firemen Collective Bargaining Act, provides
    12  a different rate, in which case the rate specified in the
    13  collective bargaining agreement or arbitration award shall be
    14  the effective rate for employees covered by that collective
    15  bargaining agreement or arbitration award and that rate may be
    16  extended to other employees of that public employer at the
    17  employer's discretion. In the absence of a collective bargaining
    18  agreement provision or arbitration award establishing a mileage
    19  fee, a rate other than 17¢ per mile may be adopted by the
    20  department, bureau, commission, agency, authority, political
    21  subdivision or intermediate unit.
    22     Section 2.  This act shall take effect immediately and shall
    23  be retroactive to July 20, 1979.
